In brief

The order is the same for almost every business and follows from what you cannot carry yourself. Liability first: injury claims are calculated over the rest of the victim's life — loss of earning capacity, domestic help, adaptations, damages for pain and suffering: and that bill takes no account of your turnover. It is the only loss that can end a healthy business in one go, and therefore the first policy.

Then continuity: your business contents, your stock and the loss of turnover when you cannot produce or supply for a period. The sum insured for business contents is replacement value as new, stock goes at cost price, and business interruption cover works with gross profit over an indemnity period you choose yourself. Anyone who cuts that period too fine only finds out while waiting for a permit or a delivery.

Staff last: during sickness you carry two years of continued wage payment plus the cost of a replacement and reintegration, and under Article 7:658 of the Dutch Civil Code you carry a duty of care for the safety of the workplace. If you work without staff, the emphasis shifts to professional indemnity insurance.

What does your premium depend on?

  • Sector and activities. The description of your activities drives the risk class; working at height, with naked flames or at third-party sites weighs more heavily than office work.
  • Annual turnover and payroll. Both are the basis of calculation for the liability premium and are adjusted after the year end against the actual figures.
  • Number of employees and agency staff. Agency workers, self-employed professionals and trainees count too; undeclared hired-in labour leads to an additional charge or an argument about cover when you claim.
  • Sum insured per section. The choice between a lower and a higher liability limit, and the replacement value as new of business contents and stock, determine the premium directly.
  • Excess. A higher excess per event reduces the premium, but only makes sense if you can carry those costs out of working capital.
  • Claims history and prevention. Notifications in recent years count, as do demonstrable measures such as certified burglary protection or a workplace risk assessment (RI&E).

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Choose the sum insured according to the risk, not your turnover

The most common mistake is matching the sum insured to the size of the business. A sole trader working at a client's home can cause the same injury as a business with fifty staff. Clients also often require a minimum sum per claim and per insurance year; watch that second figure, because two claims in one year can together hit the annual limit while each claim on its own falls within it.

Underinsurance creeps in quietly, between two valuations

You insure business contents at replacement value as new. If you buy extra machines over the years without adjusting the sum, payment is made proportionally when you claim: if two-thirds is insured, you get two-thirds of every loss: including a small one. An index clause absorbs price rises but not additions to your assets. Go through the figures every year and report building work or a major investment straight away.

Pure financial loss falls outside liability insurance

An AVB covers damage to property and injury to people. If your mistake only costs the client money (a wrong calculation, a missed deadline, advice that was incorrect) then nothing is damaged and the AVB does not pay. Service providers, advisers and designers also need professional indemnity insurance. If you do both, hands-on work and advice, you need the two policies alongside each other.

Other people's property in your care is excluded as standard

Everything you repair, work on, transport, hire or hold in safekeeping falls under the care, custody and control exclusion and is therefore excluded from cover. That hits precisely the businesses that work with other people's things every day. Care, custody and control cover is a separate extension with its own, usually limited, limit. Take stock of what belongs to third parties on your premises on an average day and match that limit to it.

Which policy should I take out first?

Liability. Injury claims are calculated over the rest of the victim's life and bear no relation to the size of your business. It is the only loss that can end a healthy business at a stroke. Clients also almost always require liability insurance with a minimum sum by contract before you are allowed to start work.

What happens if my business contents are insured for too little?

The insurer then pays proportionally. If two-thirds of the actual replacement value as new is insured, you receive two-thirds of every loss, even on a small claim. An index clause keeps the sum in step with price rises, but does not correct for machines you bought later. Go through the figures every year.

Do I need professional indemnity insurance (BAV) as well as an AVB?

If your work also involves advice or design, yes. The AVB covers property damage and injury. A mistake that only costs the client money is pure financial loss and falls outside it. Businesses that both carry out work and advise need the two alongside each other, because when there is doubt each policy points to the other.

Are my staff insured if they have an accident on the road?

Not on the liability policy, which excludes damage with or by motor vehicles. Even so, as an employer you can be liable for loss your employee suffers on the road during work. WEGAS cover exists for that. Commuting is usually outside it; check on each policy how the boundary is worded.
