In brief

Anyone who publishes runs a risk other business owners do not know: a claim about the contents of your work. An accusation that turns out not to stand up, a portrait used without consent, images for which there is no licence. The injured party usually bases the claim on tort (Article 6:162 of the Dutch Civil Code) and demands a correction and compensation.

That loss is pure financial loss: there is no injury and no damaged property. An ordinary public and employers' liability insurance does not cover it. For that you need professional indemnity insurance with an insured capacity that expressly names publishing, editing or issuing, including the cost of defence in interim proceedings.

The AVB is still needed for the physical work: injury to an extra, a lamp falling over, damage in a rented studio. And because editorial teams work with source files and subscriber data, a cyber insurance belongs in the assessment.

Where media policies come unstuck

Two points that make the difference when you claim.

The insured capacity determines everything

Your policy only covers work that falls within the described business activity. If it says 'content production' while you publish investigative journalism, or you have also become a publisher, a claim can fall outside the cover. Note the area of operationas well: many policies exclude claims under United States law, while online publications are read there. Report changes straight away. The duty of disclosure in Article 7:928 of the Dutch Civil Code continues to apply and a breach can cost you the payment (Article 7:930 of the Dutch Civil Code).

What is never covered

Outside the cover in any event are: publishing against your better judgement, deliberate acts and wilful recklessness (Article 7:952 of the Dutch Civil Code), fines and penalty payments, and redoing or refunding your own fee for work that is rejected. contractual penalties and claims arising from a dispute already known when you took out the policy also remain for your own account. Equipment and drones are insured separately.

Frequently asked questions

This is what people ask us most.

Does an ordinary AVB cover a claim for libel?

No. Public and employers' liability insurance covers injury and property damage. A claim about a publication concerns pure financial loss: reputational damage, lost turnover, the cost of a correction. That falls under professional indemnity insurance, provided it names your editorial work in the insured capacity. Without a BAV you pay both the compensation and the defence yourself.

Am I insured if I use a photo without a licence?

Often yes, but not always. Many professional indemnity policies cover unintentional infringement of copyright or image rights within a separate limit. Deliberate use without a licence counts as a deliberate act and is excluded. Check the conditions and keep your licence records up to date: when a claim arrives you have to be able to show which rights you bought.

Does the cover also apply to freelancers I hire?

Only if that is included. As standard the policy covers your own staff. If you work with freelance photographers or sub-editors, have it recorded that third parties you engage fall within the cover, or make sure they have professional indemnity insurance of their own. Ask for a policy schedule before the work starts.

Is my camera equipment included?

Not on the liability policies. Cameras, laptops, drones and lighting are insured through an electronics or business contents policy. Note the requirements for theft from a vehicle: many policies cover it only in daylight, after signs of forced entry and sometimes with a lower limit. Equipment left unattended is often excluded.
