In brief

A process operator monitors and operates installations where one wrong action quickly leads to a shutdown, an outage or injury. Liability for that follows from Article 6:162 of the Dutch Civil Code: anyone who acts unlawfully and causes damage in doing so must make it good. Whether you work on your own account or with staff, that liability is yours to carry; clients in the process industry also almost always require liability cover with a minimum sum insured.

The basis is public and employers' liability insurance, which covers injury and damage to property. What often causes friction is care, custody and control: damage to a client’s installations or tools that were in your care. There is also loss without physical damage, such as a production line standing still. That is pure financial loss and is not covered by ordinary liability cover. If you have staff, the employer’s liability under Article 7:658 of the Dutch Civil Code counts as well.

Where things go wrong in the process industry

Two points that decide whether your cover is adequate when a claim is made.

The client prescribes the cover

In chemicals and petrochemicals, contracts contain fixed requirements: a minimum sum insured per claim, cover for care, custody and control, and sometimes a statement that the client counts as a co-insured party. Safety requirements count too, such as working to VCA standards and the rules on potentially explosive zones. Put the contract wording alongside your policy before you sign. A certificate of insurance without the right sections will not help you when you claim.

What stays outside every liability policy

Not covered are intent and recklessness (Article 7:952 of the Dutch Civil Code), fines and penalty payments, gradually occurring environmental damage and damage to your own work or to goods you have supplied. Pure financial loss, such as a shutdown without physical damage, falls outside public and employers’ liability insurance. Report a claim as soon as reasonably possible (Article 7:941 of the Dutch Civil Code) and do not admit liability before the insurer has assessed the file.

Do I need liability insurance as a self-employed process operator?

It is not required by law, but in the process industry almost every client requires it by contract, with a minimum sum insured. Without cover you bear the loss yourself, and with injury or a damaged installation that can run high. Check that the amount required and the care, custody and control section appear on your policy.

Am I already covered through the client as a hired-in worker?

Not automatically. If you work under a contract for services, you are an independent contractor and not insured on the hirer’s policy. Sometimes you do count as a co-insured party, but then it says so expressly in the contract and on the policy schedule. Ask for written confirmation of that before the work starts.

Is environmental damage covered as well?

Sudden environmental damage resulting from a covered event may be included subject to conditions, but gradually occurring contamination is excluded on a liability policy. Clean-up costs on your own site fall outside it as well. Separate environmental damage insurance exists for that. In the process industry, that distinction is often the point of dispute when a claim is made.

What do I arrange for my income if I cannot work?

As a self-employed person you have no right to continued pay or sickness benefit. If you want an income during illness or after an accident, disability insurance (AOV) or joining a broodfonds (a mutual sick-pay fund) is the route. The premium depends on your occupation, the waiting period you choose, the end age and the amount insured per month.
