In brief
We act as intermediary and compare the offerings of more than thirty companies. De Goudse we often apply for on behalf of SMEs where the group personal accident cover runs within a package alongside liability, business contents and sickness absence. Which company we recommend depends on the size of your workforce and on the description of the circle of insured persons.
The value of this product lies in the speed. If an employee is injured at work, the liability route runs through Article 7:658 of the Dutch Civil Code: the employee states that he suffered loss in the course of his work, after which you have to show that you complied with your duty of care. That process takes a long time and does not always end in a payment. Alongside it, group personal accident insurance pays a fixed amount as soon as it is established that there was an accident, regardless of who was at fault. It does not cover your liability, however; the employers' liability section on the public and employers' liability insurance needed.
The second point to watch is who exactly falls under it. The policy covers the people in the circle described, generally the staff on the payroll. Agency workers, students on placement, volunteers, casual staff and self-employed contractors fall outside it as standard, while your duty of care under Article 7:658(4) of the Dutch Civil Code does apply to them. What to look out for
Four points that decide whether this arrangement does what you expect of it.
Payment without the question of fault, but not liability cover
The payment goes to the employee or to the surviving dependants and not to you as the employer. If you are held liable later, this policy contributes nothing to that. Some employers agree that the payment will be taken into account in any damages. That is a civil agreement bearing on Article 6:100 of the Dutch Civil Code on the set-off of benefits, and it has to be recorded in writing.
Occupational diseases are not accidents
The concept of an accident requires a sudden event acting from outside. That places hearing damage from long exposure, back trouble from physical load, conditions caused by solvents, RSI and burnout outside the cover. Those are precisely the claims that most often arise under employers' liability. Do not confuse the two products, therefore, in what you tell your staff.
Twenty-four hours or only during work
Cover during working hours stops when the workplace is left. Whether commuting and business travel are included is described separately. Twenty-four-hour cover continues into private life and is stronger as a benefit, but it costs more. Quite apart from that, bear in mind that injury to staff as drivers in traffic needs its own cover. The standard exclusions remain
On a group policy too, the following remain outside the cover: accidents during taking part in speed contests, air sports and combat sports, an accident in which the insured was under the influence or held no valid licence, and an accident while a criminal offence was being committed. Deliberate acts and recklessness are, under Article 7:952 of the Dutch Civil Code excluded.

Frequently asked questions
This is what people ask us most.
Does this replace the employers' liability section?
No. This policy pays a fixed amount to the employee. It does not pay the damages you may be ordered to pay as an employer. An injury claim by an employee under Article 7:658 of the Dutch Civil Code can far exceed the sum insured on a personal accident policy. Keep both covers alongside each other and match them up.
Are agency workers and interns covered?
Only if they appear expressly in the circle of insured persons. As standard the policy covers staff on the payroll. Because your duty of care under Article 7:658(4) of the Dutch Civil Code also applies to hired-in workers, a gap otherwise opens up between who you must protect and who is insured. Have the description adjusted accordingly.
Do burnout or long-term hearing damage count?
No. Both arise gradually and lack the sudden effect from outside that the concept of an accident requires. Acute hearing damage from a single blast can be treated as an accident, provided the injury can be established medically. For absence through illness, sickness absence insurance is the right product.
What do I have to do after an accident at work?
Report it to the insurer as soon as you are aware of it; Article 7:941 of the Dutch Civil Code requires that. There is also a separate statutory duty: an accident at work involving admission to hospital, permanent injury or death has to be reported immediately to the Nederlandse Arbeidsinspectie (the Dutch labour inspectorate) under Article 9 of the Dutch Working Conditions Act. Record what happened and the witness statements straight away.
