In brief
We act as intermediary and set the offerings of more than thirty companies side by side. Allianz we approach among others for business owners, directors and key staff who want a fixed payment after an accident alongside their other cover. This insurance is a fixed-sum insurance: the amount is fixed in advance and is paid regardless of the actual financial consequences. The principle of indemnity in Article 7:960 of the Dutch Civil Code, which under indemnity insurance prevents you from profiting, therefore plays no part here.
The key concept is accident, and that is narrowly defined: a sudden, unintended external violent effect on the body causing injury that can be established directly by a doctor. That means everything which arises gradually or comes from within falls outside the cover. A slipped disc from lifting, a heart attack at work, a burnout, RSI, hearing damage from years of exposure and an occupational disease are not accidents, however serious the consequences.
The payment for permanent disability is determined by a fixed percentage table for loss of function, not by a calculation of your lost income. The loss of a finger therefore gives the same percentage for a surgeon as for a bookkeeper, while the consequences for the occupation are entirely different. Anyone who really wants to cover occupation-specific loss of earning capacity ends up with disability insurance. The personal accident policy is an addition, not a replacement.

What to look out for
Four provisions that decide whether a payment is actually made after an accident.
The definition decides the outcome
Read the description of the term accident word for word. Some policies extend it with specifically named cases such as drowning, suffocation, sunstroke, frostbite, acute poisoning and wound infection. If those extensions are missing, such an event falls outside the cover. The difference between two quotations lies more often in this list than in the premium.
Loss of function, not loss of income
The disability table assigns a percentage to each part of the body. The sum insured is multiplied by that percentage. For injury that is not in the table, such as brain injury or persistent pain, a medical adviser sets a percentage on the basis of the usual guidelines. Do not count on a payment covering your loss of turnover. The basis is too rough for that.
Exclusions that matter to business owners
Excluded as standard are accidents during taking part in speed competitions with motor vehicles, air sports and flying other than as a passenger on a scheduled service, combat and contact sports and sport for payment. An accident where the blood alcohol level is above the statutory limit, or which happens while a criminal offence is being committed, also falls outside. For damage the insured causes deliberately or through recklessness, the exclusion in Article 7:952 of the Dutch Civil Code.
Reporting and the period for assessment
Report the accident as soon as you are reasonably aware of it. That follows from Article 7:941 of the Dutch Civil Code. The percentage of permanent disability is only established once the medical position is stable, and policies name a final date for that. If recovery takes longer, an estimate is made at that point. Keep the medical file complete: the assessment is made on paper.
What does your premium depend on?
- Sums insured: separately for death and for permanent disability
- Age of the insured: determines the rate and sometimes the final age
- Occupational class: office work counts differently from work at height
- Sports and secondary activities: can lead to a clause or a higher premium
- Extent of cover in time: twenty-four hours a day or only during work
- Number of insured persons: an individual or several key staff
Insurers weigh these details differently. That is where your saving is.

The difference between the two columns lies in the hours of cover per day and in whether the policy stretches the concept of an accident with named events.
Frequently asked questions
This is what people ask us most.
Does this replace disability insurance?
No. By far the most absence is caused by illness and not by an accident, and illness falls entirely outside this cover. This policy also pays a fixed amount once, not a monthly benefit. If the premium for an AOV is your objection, personal accident insurance is an addition to a narrower AOV, not an alternative to it.
Is a slipped disc or a burnout covered?
No. Both arise from within or gradually and therefore do not meet the requirement of a sudden effect from outside. The same applies to back trouble from physical load, RSI and occupational diseases. Only where an identifiable accident directly caused the injury, and that can be established medically, does cover come into play.
Is the payment set off against damages from a liable party?
Fixed-sum insurance in principle stands apart from damages: you can receive both. Whether a payment is taken into account in assessing the loss is a separate legal question turning on the set-off of benefits under Article 6:100 of the Dutch Civil Code. Where there is injury and a liable third party, have that assessed by a personal injury representative.
Does the cover apply in private life and while travelling?
That depends on the version chosen. Twenty-four-hour cover runs worldwide and therefore also in private life and on holiday; cover limited to working hours stops when you leave the workplace, with commuting arranged separately. Check this expressly, because the differences in premium between the two versions are considerable.
