In brief

We put personal accident cover with Chubb mainly where the cover has to apply worldwide and around the clock: staff on business trips, employees posted abroad, directors who fly a great deal and families staying abroad for longer periods. The product is then no longer ordinary commuting cover but cover that travels with the insured and has to hold up on every continent.

In that form the policy is usually group cover without a list of names: what is insured is a described category, for example all staff with a contract of employment or everyone who travels on instructions. That makes staff changes easy, but it shifts the weight to the description. Anyone who does not fall within it, such as a self-employed contractor brought in or an accompanying partner, is not insured unless expressly named.

Cross-border cover comes with its own provisions: repatriation and evacuation, areas subject to negative travel advice, countries covered by sanctions legislation, and flying other than as a fare-paying passenger. A personal accident policy pays no medical costs and no baggage; a travel insurance remains necessary for that. The two covers should be matched to each other.

With accident and income cover, the definition of «accident» or «incapacity for work» determines what is paid out, together with the waiting period, the end age and the occupational profile. A condition that already existed or was known when the policy was taken out is usually excluded; non-disclosure can affect the payout (Articles 7:928 and 7:930 of the Dutch Civil Code).

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

War, unrest and negative travel advice

Accidents arising from armed conflict, civil war, insurrection or mutiny are excluded. If someone travels to an area the government advises against, the cover generally falls away or applies only after express acceptance in advance. Anyone sending staff to such destinations has to submit each trip; reporting afterwards is not a workable route for this type of risk.

Flying: passenger or not

What is normally included is flying as a passenger on an aircraft operated by an airline with a regular licence. Flying as a crew member, as the pilot of a private aircraft, in a helicopter for work, or in a microlight or glider falls outside the standard cover. Parachuting and similar air sports are also generally named separately as excluded activities.

The sanctions and territory clause

International policies contain a provision that there is no cover or payment to the extent that it would breach sanctions legislation. If your organisation works in countries subject to sanctions, a loss there can prove unpayable, however clear the description of cover otherwise is. Have it checked in advance which countries appear on the policy and which are expressly excluded.

The description of the group is the cover

Without a list of names, the description determines who is insured. If a student on placement, an agency worker, a consultant brought in or an accompanying partner does not fall within it, there is no claim after an accident, even though that person travelled on instructions. Go through the description each year, because organisations work with ever more forms of contract for which the original wording was not written.

What does your premium depend on?

  • Size and composition of the group. The number of insured persons and the categories they are placed in form the basis.
  • Area of cover. Europe, worldwide, or worldwide excluding named countries and sanctioned territories.
  • Frequency of travel and destinations. The number of travel days and the risk profile of the countries travelled to.
  • Occupational classes within the group. Office staff, engineers on site and fieldwork in harsh conditions all count differently.
  • Sums insured and sections. Fixed amounts or a multiple of the annual salary, plus sections such as repatriation and evacuation.
  • Hours of cover per day. During work and business trips only, or continuously including private time at the destination.

Does the cover apply during free time on a business trip?

That depends on the form chosen. With cover limited to work and business trips, an accident at the weekend at the destination can fall outside the cover. With full round-the-clock cover that distinction does not arise. For staff posted abroad, the latter form is the workable choice in practice.

Are accompanying partners and children insured?

Only where they appear in the group description. On a posting the family often travels too, but the standard description generally names only staff. Have family members expressly included for a long placement, together with the question of which sums insured apply to them and whether the cover also applies during leave in the Netherlands.

What happens where there is negative travel advice?

For areas the government advises against because of war or unrest, the cover usually falls away, or applies only after prior written acceptance. If the advice changes while someone is on the spot, transitional provisions with a period in which to leave often apply. Record for each posting what was agreed at the time.

Does this policy replace travel insurance?

No. A personal accident policy pays a fixed amount on death or permanent disability. Medical costs abroad, patient transport, baggage and assistance through an emergency centre do not fall under it. For travelling staff both covers are needed, and it is sensible to arrange them with the same party or at least so that they dovetail.
