In brief

The 3 Series is BMW's volume model and is on the road in the Netherlands both as a saloon and as a Touring, often with a high annual mileage. A large share is driven for business: on a lease contract, as a company car or as a private car used for work every day. That is not a detail for the premium but a separate question on the application form.

With a lease car you are usually not the policyholder. The leasing company is the owner and arranges the cover in the contract; during that period you build up no no-claims years of your own. If you later go back to a private policy, you start lower than you expect. If you drive the car in your own name but for business, that use belongs in the application; Article 7:928 of the Dutch Civil Code requires you to declare it correctly.

And there is a third party: your employer. If you drive in the course of your work, Article 7:611 of the Dutch Civil Code bears on whether they have arranged proper insurance for your own losses. What does your premium depend on?

  • Business or private use. Client visits, commuting and purely private use are assessed differently.
  • Annual mileage. Often the decisive factor on this model; high-mileage drivers are on a different scale.
  • Trim level and engine power. A 318d, a 330e plug-in hybrid and an M340i xDrive do not fall in the same category.
  • No-claims years and where they come from. Years you built up yourself count in full. A lease statement depends on underwriting policy.
  • Security and storage. A tracking system, a locked parking space and where the car stands at clients during the day all count.
  • Cover, excess and glass arrangement. Repairs within the insurer's network usually produce a lower excess.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Business use is a separate question, not a nuance

Commuting is different from visiting clients all day, and both are different from carrying goods for payment. That last category falls outside an ordinary private car policy, as do driving lessons, hire and shared use through a platform. Declare on the application what you actually do. If your work changes during the term, report it; a change in risk that has not been passed on comes back after a claim.

In a lease car you build up no no-claims years

The policy is in the leasing company's name, so the build-up passes you by. Anyone who drives a lease car claim-free for years and then buys a car themselves starts on a low step. Some insurers recognise a statement from the leasing company about your claims record and allow some latitude for it. That is not a right but underwriting policy. Request that statement before the contract ends, not afterwards.

Keyless entry and theft without signs of forced entry

On cars with a hands-free system, the key's signal is picked up inside the house and amplified, after which the car opens and starts without any damage. Insurers therefore impose requirements: a signal-blocking pouch, an approved tracking system or locked parking. If such a requirement is in your policy and you do not comply with it, the theft is not covered. Read the security clause on your policy schedule before things go wrong.

Driving on liability for the boss

If you cause damage to a third party during working hours, the employer is jointly liable for it under Article 6:170 of the Dutch Civil Code. In principle they cannot recover that loss from you, unless there is intent or wilful recklessness. That follows from Article 7:661 of the Dutch Civil Code. If you drive the company car privately, that falls outside that protection. Record what private use is permitted.

Not every company applies the same policy for this make. With unusual versions, the question is not what it costs but who will accept it.

This is what people ask us most.

I drive a lease car. Do I still need to insure anything myself?

The liability and own-damage cover are in the lease contract, but your own injury as the driver usually is not. There is motor passenger insurance or personal accident insurance for that. If your employer does not arrange it, that is the gap. Also look in the contract at the excess per claim and whether it is recovered from you. That last point can be insured separately.

Does business use count more heavily in the premium?

Usually it does, but not because it is called business use. What matters is the mileage, driving in rush hour and where the car stands during the day. If you carry goods or people for payment, an ordinary private car policy is not adequate and a different type of policy is needed. Declare the intended use on the application, and it will be taken into account in underwriting.

My 3 Series has been stolen with no signs of forced entry. Will that be paid?

That depends on your security clause. The insurer will ask for both keys, for a police report and for evidence that you complied with the requirements imposed: the pouch, the tracking system or the parking arrangements. If all the keys are there and the conditions have been met, there is no reason to refuse. If a key or a required device is missing, an argument follows.

Who pays if I cause damage to someone else with the company car?

The vehicle's third-party liability cover pays the injured party; Article 2 of the Dutch Motor Insurance Liability Act (WAM) guarantees that. Your employer is also liable alongside you under Article 6:170 of the Dutch Civil Code. Recovery from you personally is only possible in the case of intent or wilful recklessness (Article 7:661 of the Dutch Civil Code). Your employer can charge you the excess if that has been agreed contractually.
