Legal expenses insurance for a VvE provides legal help with disputes concerning the building and its management: with contractors about work carried out, with suppliers and managing agents, and with individual owners.
The debt collection module is in practice the section used most. Overdue VvE contributions have to be collected, and that is also a board duty for which a board member can be liable if it is neglected.

What to look out for
Collection of overdue contributions
Collecting is not a choice but a duty. A module that takes over that process relieves the board and limits its liability.
A three-month waiting period
A dispute already running or foreseeable when the policy was taken out is excluded. Take out cover when things are calm, not once the conflict is there.
A dispute with the managing agent
A conflict with the management company also falls under the cover, provided it was not already running when the policy was taken out.
Free choice of lawyer in legal proceedings
If it comes to court proceedings, the VvE may choose its own lawyer, within the policy's cost maximum.

Is collection of VvE contributions covered?
With the debt collection module, yes, usually from a minimum amount per claim and after the waiting period. It is the section used most by VvEs.
Is there a waiting period?
Yes, usually three months. A dispute already running or foreseeable when the policy was taken out is excluded.
Can the VvE insure a conflict with the managing agent?
Yes, provided the dispute arises after the waiting period. No insurer takes over a conflict already under way.
May the VvE choose its own lawyer?
In court or administrative proceedings, yes. Outside those, the insurer handles the case with its own lawyers.
