The core of the product is not the money but the response service: when an incident is reported, a specialist crisis adviser is engaged who guides the negotiation and steers the organisation through the process.

Alongside ransom and its loss in transit, the cover normally pays the adviser's fee, continued salary during a disappearance, medical and psychological aftercare, travel and accommodation costs for the family, and legal assistance. Elements such as extortion without kidnapping and wrongful detention can often be switched on or off separately.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Confidentiality is a condition, not advice

Almost all policies in this segment provide that the existence of the cover may not become known outside a very small circle within the organisation. The reason is obvious: publicity increases the very risk the cover has to absorb. Breach of that provision can cost you the cover. So do not include the insurance in staff regulations, terms of employment, annual accounts or tender documents.

The response adviser first, only then a payment

The policy normally requires immediate notification through an emergency number and the engagement of the appointed crisis adviser before there is any negotiation or payment. Article 7:941 of the Dutch Civil Code requires notification in any event as soon as you know of the event. If you act on your own initiative and pay without the adviser, you risk the amount paid not being reimbursed, because the insurer has been unable to assess how matters were handled.

The duty of care as an employer stays with you

If you send staff to high-risk areas, the obligations under Article 7:658 of the Dutch Civil Code and the additional standard of Article 7:611 of the Dutch Civil Coderest on you: information, training, travel protocols and following official travel advice. Insurance does not take over that duty. It pays the costs of an incident, but it does not protect you against a claim from an employee who says you took insufficient measures.

What falls outside the cover

Excluded are incidents in which an insured, a family member or an employee is involved as an accomplice, and payments to parties covered by a sanctions or embargo regime. There is also no cover if the existence of the policy has been disclosed, and often none for travel to areas subject to negative travel advice without prior consultation. Earlier incidents or threats that were concealed affect the duty of disclosure when the policy is taken out.

What does your premium depend on?

  • Number of insured persons and their role. Board members and recognisable faces of the organisation weigh more heavily than operational staff.
  • Countries and regions. Where people work, travel and stay is the most important factor for this product.
  • Sector and visibility. Sectors seen as wealthy or politically sensitive are assessed differently.
  • Cover components chosen. Ransom, extortion without kidnapping and wrongful detention can be switched on or off separately.
  • Security and travel protocols. Recorded procedures, training and following travel advice work through into the acceptance.
  • History of incidents and threats. You must report earlier incidents or specific threats; they help determine whether and how the risk is accepted.

What happens immediately after a report?

You call the emergency number given in the policy. The insurer engages the appointed crisis adviser, who contacts a previously named point of contact within your organisation and guides the rest of the process: communication, contact with the authorities and the family, and any negotiation. Paying or negotiating without that adviser puts the reimbursement at risk, even if the incident itself is covered.

May I tell people within the organisation that we have this cover?

Only within the very limited circle the policy allows. The confidentiality provision is a condition of cover, because publicity increases the risk. So do not put the insurance in staff regulations, terms of employment, annual accounts or tender documents. Agree in advance who the point of contact is and where the policy details and the emergency number can be found.

Does the cover also apply to family members travelling with staff?

That depends on the circle of insured persons you agree. In many arrangements partners travelling with staff and children living at home can be insured as well, and sometimes local staff too. This is an express choice that has to be stated on the policy. Also record what applies during private travel added on to a business trip, because there is often a boundary there.

Is extortion without kidnapping covered?

Only if that element is included. Threats of violence, of damage to property or of disclosure of data come under extortion and are usually a separate module. Wrongful detention by local authorities is a separate element as well. When taking out the policy, go through expressly which scenarios you do and do not want covered. It is not an all-in-one cover.
