In brief

The Bewust road users' insurance is a loss-based insurance for road users. The members of your household are insured while taking part in traffic: as a driver, as a passenger, on a bicycle, on a scooter and as a pedestrian. It pays the loss actually suffered, so personal injury, loss of income, domestic help and adaptations, and under most variants also property damage such as clothing, a bicycle or a laptop.

That makes this cover fundamentally different from personal accident insurance, which pays an amount agreed in advance regardless of the actual loss. Here it is about compensating what you can demonstrate you have lost. That is precisely why this policy fills the gap that remains when the other party is unknown, uninsured, or when you caused the collision yourself.

The compulsory liability insurance under Article 2 of the Dutch Motor Insurance Liability Act (WAM) pays only for damage caused to others by the motor vehicle. Your own injury as the driver at fault falls outside it. For damage to the car itself you still need a car insurance with own-damage cover. This policy is about people, not about the vehicle.

What does your premium depend on?

  • Composition of the household. The number of people co-insured determines how many road users fall under the policy.
  • Age of the drivers. Young and very experienced drivers carry a different accident risk.
  • How you take part in traffic. Daily scooter use or mainly travelling as a passenger gives a different picture from occasional car use.
  • Area of cover. The Netherlands only, Europe or wider; journeys abroad count towards the rate.
  • Cover chosen. Personal injury only, or injury plus the property damage of the occupants and their luggage.
  • Excess and claims history. Earlier traffic claims and the excess you choose feed through into the premium.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Also where no liable other party exists

If a hit-and-run driver collides with you, or you drive into a lamp post yourself, there is no one to hold liable under Article 6:162 DCC. This policy still pays out, because cover is not tied to fault but to taking part in traffic. The same applies to a single-vehicle cycling accident or where the liable party cannot pay enough.

The car itself is not insured

Damage to the motor vehicle you were driving falls outside this cover. A dented door, a burnt-out engine or a stolen car remains a matter for the own-damage cover on the motor policy. Cargo, a trailer and accessories fitted to the vehicle are usually excluded as well. The policy pays for the losses of people, plus the items they had with them.

Driving licence, intoxication and speed events

Excluded as standard are accidents in which the driver had no valid driving licence, was under the influence of alcohol or drugs, or was taking part in a speed or skill competition. The same applies to use of the vehicle for paid passenger transport or hire without disclosure. Damage caused intentionally also runs up against the exclusion in Article 7:952 DCC.

Who is insured, and where the employer comes in

The household as stated on the policy is insured. If a child moves out or a partner joins, that should be notified. If you drive for work or commute, Article 7:611 DCCalso comes into play: an employer may be required to arrange proper insurance for employees who take part in traffic. Both covers can exist alongside each other.

This is what people ask us most.

Is this the same as passenger accident insurance?

No. Passenger accident cover is a fixed-sum insurance: it pays a set amount on death or permanent disability. This policy pays for the loss actually suffered, including loss of income, domestic help and adaptations, and it is not limited to the occupants of a particular car but applies to every form of taking part in traffic.

Am I also covered on a bicycle or on foot?

Yes, that is what characterises this cover. What is insured is the co-insured persons' participation in traffic, whatever the means of transport. A fall from a bicycle on a slippery road, a collision as a pedestrian on a crossing, or injury as a passenger in someone else's van all fall within the same cover.

What if the other party drives off or is uninsured?

You can then turn directly to your own insurer. This policy is intended precisely for such cases: no liable party has to be identified. Do report the matter to the police and notify the incident as soon as possible, because Article 7:941 DCC requires you to report the loss in good time and to cooperate in establishing it.

Does the cover also apply abroad?

That depends on the agreed geographical scope. Most variants apply within Europe, some worldwide for temporary stays. If you regularly drive outside Europe or live elsewhere temporarily, have the area recorded expressly. When comparing policies we look at this point specifically, because insurers define it differently.
