In brief

Alongside the compulsory liability cover you can choose third-party, fire and theft or comprehensive cover. Third-party, fire and theft covers a listed series of events: fire, theft, storm, glass damage and a collision with an animal. Comprehensive adds the damage you cause yourself. On an MP3, the difference between the two lies above all in fall damage with no other party involved. Theft is the scenario insurers are keenest on with this type of vehicle. The policy sets requirements for the lock and the storage: an approved, certified lock, sometimes combined with a second lock or a tracking system, and locked storage at night. If the situation at the time of the theft does not meet the clause, cover for that event lapses. Keep the certificate for the lock and all keys; anyone missing one of them when reporting a claim is almost always declined.

These machines usually carry plenty of accessories: a top box, a tall screen, heated grips, a satnav mount, a leg cover. They are insured only if they are named on the policy schedule, and then usually within a separate section with a limit of its own. What lies inside the box is not part of the vehicle and does not fall under it. Motorcycle clothing and helmet call for a separate agreement; under many policies they are paid for only after a collision.

Four patterns of loss that come up most often with this vehicle.

Falling over on the stand

A three-wheeler is heavy and falls over if the tilt lock is engaged wrongly or on a sloping road surface. There is then no other party and no external cause in the classic sense, so that third-party, fire and theft pays nothing. Under comprehensive it is generally covered, unless the insurer makes it plausible that it was a defect in the vehicle; inherent defect is excluded under virtually every policy.

Theft and what the insurer then asks for

On notification you are asked for: a police report, all keys, the lock certificate and the complete registration certificate. If a key is missing or the lock turns out not to have been used, the usual outcome is a rejection. Bear in mind that for theft a a higher excess often applies than for other own damage, and that payment follows only after a waiting period.

Accessories and the depreciation arrangement

Have accessories named on the policy schedule and keep the invoices. Without that entry there is no cover, even where they were fitted at purchase. Also look at the valuation arrangement: many policies use the purchase price for the first few years and then move to market value. On a vehicle that loses its value quickly, that arrangement determines what you are left with on a total loss.

Four causes that own-damage cover does not pay for

Wear and mechanical and electrical failure are not own damage but maintenance. A fall in value after a proper repair is not paid for. Riding under the influence or leaving the scene of the accident leads to loss of cover, and damage caused by intent or recklessness falls under Article 7:952 of the Dutch Civil Code. If you fail to notify, that engages Article 7:941 of the Dutch Civil Code.

What does your premium depend on?

  • List price and year of manufacture: determines the own-damage premium and the valuation basis
  • Value of the accessories: panniers, screen, alarm and satnav
  • Security level: certified lock, alarm or tracking system
  • Storage at night: garage, locked inner courtyard or public road
  • Annual mileage: daily commuting or fine weather only
  • Excess per event: often a different amount for theft

This is what people ask us most.

I fell over while stationary. Is that covered?

Under comprehensive, usually yes; under third-party, fire and theft, no. Third-party, fire and theft works with a closed list of events and falling over is not on it. If the fall arises because a part of the vehicle failed, the exclusion for inherent defect also comes into play and the insurer limits the payment to the consequential damage, not to the defective part itself.

My MP3 has been stolen. What happens now?

You report it to the police, notify the insurer and hand in the keys, the lock certificate and the registration certificate. There is usually a period in which the vehicle is still searched for before payment is made. The amount follows from the valuation basis and the excess for theft. You arrange the discharge of the registration through the RDW (the Dutch vehicle authority).

Are the contents of my top box insured?

No. Own-damage cover concerns the vehicle and the accessories listed, not what you carry. A stolen laptop, tools or shopping fall outside it. Home contents or travel insurance sometimes provides limited cover for this, and if you use the items for business, separate cover for mobile equipment is the appropriate route.

Does comprehensive pay on an older example?

That depends on the market value and on your excess. Once the market value falls to an amount you can afford to lose, you are paying for own-damage cover that yields little on a total loss. The middle way — third-party liability with third-party, fire and theft — is then often more sensible: you keep cover for fire and theft, the two events that cost you the whole vehicle.
