In brief

An open mobility scooter is a disabled person's vehicle without a cabin, with a limited design speed. Unlike a motorcycle or moped, this type generally does not require registration and falls outside the insurance obligation of Article 2 of the Dutch Motor Insurance Liability Act (WAM). Anyone who causes damage remains liable all the same under Article 6:162 of the Dutch Civil Code. A collision with a cyclist or injury to a pedestrian can lead to a claim that runs on for years.

The policy names who may use the vehicle. On mobility scooters that is a real point: the vehicle is often lent within the household or used by a carer. If that user is not on the policy while that is in fact the settled position, the insurer can rely on an incorrect statement after a loss. So report it in advance.

Alongside liability and own-damage cover, two additions are useful. Assistance makes sure that after a breakdown or with a flat battery you are brought home with the vehicle. On a mobility scooter that is no luxury, because you cannot simply lift it into a car. A personal accident cover pays an amount for permanent injury or death after an accident with the mobility scooter. Both are optional and are only on the policy if you take them out.

Where things go wrong on an open mobility scooter and how to prevent it.

Liability continues, even without a compulsory insurance obligation

The fact that an ordinary mobility scooter falls outside the insurance obligation of Article 2 of the Dutch Motor Insurance Liability Act (WAM) does not mean that you run no risk. Anyone who causes loss to another is liable for it under Article 6:162 of the Dutch Civil Code. Injury losses to a pedestrian or cyclist can run to amounts that a private individual cannot bear. So check whether your personal liability insurance includes disability vehicles. If not, take out a mobility scooter policy with liability cover.

Put the actual users on the policy

A mobility scooter is often used by more than one person: a partner, a member of the household or a carer. The insurer works from the user you stated when you applied. If the vehicle is used by someone else on a structural basis, or if you hire or lend it out regularly, that belongs on the policy. On taking out the policy, the duty of disclosure under Article 7:928 of the Dutch Civil Codeapplies; a breach of it can cause payment to lapse (Article 7:930 of the Dutch Civil Code).

What is not covered

The following, among others, are outside the cover: theft without the prescribed security or from an unlocked place; use off-road, on the beach, in the dunes or in woodland, where the policy gives no cover; taking part in speed and skill events; and, on registered faster versions, driving without a driving licence valid for that category. Wear, gradual loss of battery capacity, damage from incorrect charging and damage through intent or recklessness (Article 7:952 of the Dutch Civil Code) are excluded.

Arrange assistance and transport in advance

If you are stranded on the road with a flat battery or a puncture, an open mobility scooter is difficult to move. So take out assistance cover and check whether it also applies with a flat battery. Some policies regard that as your own responsibility. Also note that damage during transport on a trailer or in a van is not included in every policy. Ask about that before you take the vehicle on holiday.

Frequently asked questions

This is what people ask us most.

May someone else ride my mobility scooter?

Occasionally that is allowed under most policies, but structural use by someone else should be reported. The insurer has based the premium on the user you stated. If someone else regularly rides it, let us know. Hire and business use are practically always excluded under a private policy.

Am I insured if I ride the mobility scooter into a shop?

Yes, liability cover applies not only on the public road. If you run into a shelf, a door or a display indoors, that damage comes under the cover for damage to third parties. Damage to your own mobility scooter does not come under it; own-damage cover is needed for that. Always report the incident, even where the shopkeeper says at the time that they will let it go.

Does own-damage cover make sense on an open mobility scooter?

That depends on the value and where it is kept. On a recent model with a high purchase price, own-damage cover outweighs the premium, certainly where the vehicle stands in a communal storage room in which theft and vandalism occur. On an older second-hand example with a low market value, liability cover alone is often enough. Reassess it each year.

What happens in an accident in which I am injured myself?

Your own injury does not come under liability cover. That exists for damage to others. If you want to cover it, you take out personal accident cover that pays an amount for permanent injury or death. Medical costs run through your health insurance. In a collision in which someone else is at fault, you can recover your loss from that party.

May I take the mobility scooter on holiday?

Often you may, but check two things. First, whether the policy gives cover in the country you are going to. The territorial limits are set out in the conditions. Second, whether damage during transport on a trailer or in a van is included, because that is by no means always the case. Arrange this before you leave and ask for written confirmation.
