In brief
Businesses with more than a few trailers often bring them together under one contract, with a schedule of objects that is kept up to date. That works well, provided the schedule is correct. A trailer that has been bought but not declared is not covered: not even if it stands on the same site as twenty objects that are insured. Agree who does the declaring and within what period.
The second point is the moment at which the WAM cover of the towing vehicle stops. That cover applies to a trailer that is coupled, or that has come loose from the vehicle but has not yet come safely to a standstill away from the traffic. Once the trailer stands uncoupled at a loading bay, on an industrial estate or at a customer's premises, that cover no longer works. If it then rolls away, or the drawbar drops onto a parked car, that is an ordinary liability question under Article 6:162 of the Dutch Civil Code and the public and employers' liability insurance into view.
The third point is ownership. If you hire trailers in, or if a client's equipment is standing on your site, that is not your property but is in your care. The care, custody and control exclusion on the liability policy takes that damage out, and the hire company's own own-damage policy does not automatically cover you. What to look out for
Four points that most often lead to argument with a collective contract and varying deployment.
Objects that have not been declared
Cover follows the schedule of objects. Newly bought equipment, temporary replacements or equipment that came with a business you took over falls outside the policy until it has been declared. Article 7:928 of the Dutch Civil Code requires you to give correct and complete information. An incorrect statement can, under Article 7:930 of the Dutch Civil Code lead to a reduction or loss of the payout.
Hired or borrowed equipment
For a trailer you hire you are usually contractually liable for damage and theft, while your liability insurance specifically does not cover that damage because of the care, custody and control exclusion. Arrange this in advance: hirer's cover, an additional care, custody and control clause, or written confirmation that the hire company holds own-damage cover.
The load and the loading process
Goods carried are not covered by this policy. Damage to a customer's goods during carriage belongs on a goods in transit insurance. If you damage the client's floor, wall or a machine while unloading, that is liability: and there too the care, custody and control exclusion may apply if you had the item in your care at that moment.
Theft and overnight storage
With a company fleet there is almost always a storage and security clause on the clauses page: fenced site, coupling lock, sometimes a tracking system. If that is routinely departed from because a driver takes the trailer home, that is a reason to reject a theft claim. Have any different storage arrangement insured in writing.
What does your premium depend on?
- Number of objects on the contract: larger numbers lead to a different structure
- Total insured value: the total of all declared trailers
- Type of transport: carrying your own goods, courier work or construction logistics
- Storage and site security: fencing, cameras and lighting
- Area of cover: the Netherlands only, or cross-border as well
- Claims record over several years: decisive for the discount on a fleet contract

The third-party liability cover of the towing vehicle only deals with damage to other people; all damage to the trailer itself calls for own-damage cover.
Frequently asked questions
This is what people ask us most.
Does every trailer have to be listed on the policy?
Yes. Even with a collective contract, cover applies per declared object, with a sum insured of its own. Work with a fixed procedure for declaring objects and check the schedule at every renewal. A trailer you bought three months ago and have not yet reported is not insured against fire or theft, however long you have been a customer.
We hire in extra trailers at peak times. How does that work?
Read the hire agreement first: it usually places all damage and theft with the hirer. Your liability insurance generally does not cover this, because the item is in your care. So establish in advance whether the hire company holds own-damage cover and with what excess, or add temporary cover to your own contract. It cannot be put right afterwards.
Does the cover also apply abroad?
That depends on the territorial limits on the policy schedule. For third-party liability, the green card of the towing vehicle works within the agreed area. The own-damage cover on the trailer may have a narrower area. If you regularly cross the border, have that expressly included rather than assuming it runs along with the rest.
What if a driver is injured while coupling?
That is employer's liability and does not run through this policy. Article 7:658 of the Dutch Civil Code requires you to provide a safe working environment and sound equipment, and subsection 4 extends that duty to hired-in staff and self-employed professionals (zzp'ers) working for you. Report the injury to your liability insurer as soon as you know about it; Article 7:941 DCC requires that prompt notification.
