Third-party liability
- Damage to other cars and injury
- No cover for your own car
- Compulsory under Article 2 of the Dutch Motor Insurance Liability Act (WAM)
- Rarely suitable for this segment
List price · security · repair costs
With a luxury car it is not only the new price that determines the premium, but above all the combination of theft appeal, repair costs and the question of how the value is established when you claim.

A luxury car — a large saloon, a top specification of an SUV or a car from the premium segment — is a different product to an insurer than a mid-range model. The list price puts the car in a higher premium class, but two other things weigh more heavily: the theft figures for the model concerned and the repair costs. Aluminium or mixed body panels, matrix lighting, air suspension, large wheels and radar and camera sensors make an apparently minor collision expensive, because the assistance systems have to be calibrated after replacement.
Third-party liability cover is compulsory under Article 2 of the Dutch Motor Insurance Liability Act (WAM) and pays only for damage to someone else. For damage to the car itself you need own-damage cover . On a young luxury car, comprehensive cover is almost always worthwhile: the difference in premium against third-party, fire and theft is nothing next to one repaired front end. Note the a replacement-value-as-new or purchase-value arrangement, which for a period stated in the policy pays out on the basis of the original price rather than the market value.
For older or unusual examples the emphasis shifts to the determination of value. Where there is no reliable reference market, a valuation by a recognised valuer is sensible; under Article 7:960 of the Dutch Civil Code the agreed value recorded in the policy is then the starting point, instead of a market value estimated only after the loss.
Three forms of cover, with the situations that arise most often in this segment beneath them.
The legally required cover for damage you cause to others.
As well as third-party liability, a fixed list of events: theft, glass, fire, storm and collision with animals.
Also damage to your own car caused by you or without a third party involved.
What is covered
| Situation | Third-party liability | Comprehensive |
|---|---|---|
| Damage you cause to someone else | Yes | Yes |
| Theft of the car, the wheels or the mirror caps | No | Yes |
| Replacement of a windscreen with a camera, including calibration | No | Yes |
| Damage to your own car after a single-vehicle accident | No | Yes |
| A replacement vehicle in the same class | No | Provided that |
| Theft where the prescribed security was missing | No | No |
What is actually covered, including exclusions, limits and the excess, is set out in the policy conditions and the insurance card (verzekeringskaart) that you receive before you take out cover.
Four points that lead to argument more often in this segment than with an average car.
For models attractive to thieves, insurers set additional requirements: an approved alarm system, a vehicle tracking system or storage in a locked space. That requirement appears as a warranty clause in the policy. If it has not been met at the time of the theft — the tracking system was not activated, the subscription had expired, the car was parked on the street when garage storage had been agreed — the insurer may refuse the claim. With keyless entry this is particularly relevant: keys can be read remotely, and insurers therefore sometimes require a shielded key pouch or additional security.
Check whether the policy allows repair by a manufacturer-approved workshop or directs you to an affiliated chain, and whether the insurer pays for original manufacturer's parts or may also use equivalent alternatives. On a young car with a leasing history or an imminent trade-in, that difference can be considerable. Ask as well whether the policy pays for loss of value after repair : bodywork repaired to a technically correct standard still lowers the resale value, but many policies do not pay for that loss.
The following, among others, are outside the cover: wear and tear and mechanical or electronic defects without a collision, such as failed air suspension or a failed transmission; damage during speed or skill trials and on a circuit, even at a private event; and damage during hire or other commercial use where the policy assumes private use. Theft where the prescribed security was not in operation is also excluded. Damage caused intentionally or recklessly is excluded under Article 7:952 of the Dutch Civil Code.
On taking out the policy, the duty of disclosure applies under Article 7:928 of the Dutch Civil Code: the specification, whether the car was imported, accessories, claims history and who the regular driver is. If you conceal something the insurer would have assessed differently had it known, the payout may be reduced or refused (Article 7:930 of the Dutch Civil Code). If something changes in the meantime — a second driver, different storage, a considerably higher annual mileage, chip tuning or different wheels — report it immediately. Report a claim as soon as reasonably possible (Article 7:941 of the Dutch Civil Code).
Insurers weigh these details differently. That is why comparing pays off.
Customers rate our service on four aspects: personal service, service delivery, availability and the outcome. The reviews are collected and published by NH1816 and come from customers who have actually taken out a policy with Finass Advies B.V. or reported a claim.
The questions we are asked most often about this.
Because the chance of theft is demonstrably higher for certain models and a tracking system improves the chance of recovery. The requirement appears as a condition in the policy, often with an obligation to keep the subscription active and to report a theft to the control room immediately. If the system has not been installed or the subscription has expired, the insurer may refuse a theft claim.
Usually not automatically. Standard arrangements provide a car from a basic class. If you want an equivalent replacement, an additional module is needed, and even then a maximum period and a maximum amount per day often apply. Check this before you take out the policy, because with a large or highly specified car the difference is noticeable in practice.
For a common model with an active second-hand market usually not: the market value can then be established readily. For a rare specification, an import or a car with a long list of options it is, because options often barely raise the market value even though you paid for them. A valuation under Article 7:960 of the Dutch Civil Code then fixes the value in advance.
Report it before the modification. An increase in power is an increase in risk; some insurers accept it for an additional premium, others decline the car. If you carry it out without reporting it, the insurer may reduce or refuse a payout and in the last resort terminate the policy. The same applies to suspension modifications and non-factory wheels or exhausts.
Cover applies within the countries listed on the green card, but its extent can vary. Pay particular attention to own-damage cover while abroad, to repatriation of the car after an accident and to whether assistance is included in the policy or is a separate module. If you drive outside Europe, never assume cover without written confirmation.
