In brief

The United States appears separately on the policy schedule. A policy called worldwide can exclude the United States and Canada or include them only for a surcharge. Check that before you book and not on departure: if the destination is not insured, there is no cover, not even for a loss that has nothing to do with healthcare costs.

The reason for that separate treatment is that care in the United States is private and invoiced per procedure, without a tariff list to hold on to. A hospital asks for a payment guarantee in advance. Without an undertaking from the emergency assistance centre you end up in the situation where you advance the money yourself and are still receiving late invoices months later.

The liability climate also differs: claims are brought more readily there and defence is expensive, even where you are ultimately found to be in the right. If your staff also travel to other continents, read worldwide business travel insurance.

What does your premium depend on?

  • Number of travel days in the US and Canada. Insurers calculate this area separately from the other destinations on the policy.
  • Insured permanently or per trip. Annual cover for the area is assessed differently from notification for each individual trip.
  • Limit chosen for medical expenses. Because the invoices there mount up per procedure, the level of the medical limit is decisive.
  • Age of the travellers. The chance of a hospital admission weighs more heavily in this area because of the cost level of care.
  • Activity on the spot. Attending a trade fair and negotiating are weighed differently from installation, assembly or service work at a client's premises.
  • Liability with United States jurisdiction. Extending the jurisdiction to the US and Canada is a separate choice on the liability cover.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

The area of the US and Canada has to be expressly insured

Check on the policy schedule whether it says worldwide including USA and Canada. If that addition is missing, the trip falls outside the area of cover and even a stolen laptop or a curtailed trip is not paid for. On a continuous policy you insure the area per year, on individual trips per trip. Report a stopover or transit as well, because it can fall within the same area.

Care is settled in advance and per procedure

Hospitals and clinics ask on arrival for a payment guarantee or a credit card authorisation. The emergency assistance centre can issue that guarantee and choose an institution it has arrangements with. If you arrange it yourself, you receive separate invoices from the hospital, the treating physician and the ambulance service, sometimes only months later. Those late bills still have to be submitted, so keep every document and every acknowledgement of receipt.

Liability under United States law is a separate question

Many public and employers' liability insurances have an area of cover of Europe or exclude judgments under United States law. If you visit clients or supply goods there, check whether the jurisdiction of the US and Canada is included and whether defence costs fall within or above the sum insured. Damage caused intentionally remains excluded under Article 7:952 of the Dutch Civil Code, and fines imposed are not insurable under Dutch law.

Hire car: the statutory limit there is low

WAM article 2 applies only to the Netherlands and the designated treaty area. In the United States state minimums apply that are soon inadequate where there is serious injury. Business travel insurance does not cover motor liability, so you top that up with the hire company. If your employee drives on business, good employment practice under Article 7:611 of the Dutch Civil Code also plays a part in a road accident.

Why do the United States form a separate area of cover?

Because the cost level of care there is not comparable with Europe and insurers calculate the risk separately. One admission produces invoices from several parties at once. On top of that, liability claims there are higher and defence is more expensive. Insurers therefore offer the area as a separate choice, with its own premium loading.

Am I covered during a stopover at a United States airport?

Not automatically. Transit through the United States can fall under the same excluded area as a stay, certainly where you have to pass through immigration. State the full route when you apply, including stopovers, and have the insurer confirm whether transit is insured. Otherwise you are without cover in the event of a missed connection or a medical incident.

Does the business travel policy cover a claim by a United States party against my company?

No. Business travel insurance pays the traveller's own costs: care, repatriation, luggage and interruption. A third-party claim falls under your public and employers' liability insurance, and only where the area of cover and the jurisdiction include the United States. Have that checked before the trip; extending it afterwards does not help for an event that has already occurred.

Do I have to buy extra liability cover with a hire car?

That is sensible. The statutory minimum cover per state is low and covers only part of the loss where there is serious injury. Business travel insurance does not cover motor liability, so you top that up with the hire company. Record who within your company may drive there and check that the driving licence and the hire company's age requirement are in order.
