In brief

A privately owned lorry is often a classic, modern classic or restored example: a classic rigid lorry, a tractor unit from the eighties or a former commercial vehicle given a second life. For the insurer, what is special is not the weight but the way the value develops. Unlike a working vehicle, the value does not fall in a straight line. With a well-restored example it even rises.

The basis remains laid down by law: Third-party liability cover is compulsory under Article 2 of the Dutch Motor Insurance Liability Act (WAM) as long as the registration is in your name and has not been suspended. For damage to the lorry itself you need own-damage cover. The question is then not only or you choose own-damage cover, but above all on what basis of value: market value, purchase price or a value agreed in advance.

Two things are systematically underestimated in private ownership. First: the load does not fall under the own-damage cover. If you carry a classic car, furniture or tools, that is not insured under the lorry policy. Second: loose parts and restoration stock in the shed are not covered by the motor policy either. For those you look at contents, business contents or goods insurance.

Which cover suits private ownership?

Three forms of cover, with the situations that most often arise with a private lorry set out beneath them.

Valuation and provenance

Four points that determine the payment with a privately owned lorry.

A valuation above market value

With a classic or restored lorry the market value is a poor yardstick: it does not take account of years of work, rarity or original parts. Article 7:960 of the Dutch Civil Code offers the solution. Have the value established by an expert before you take out the policy. That valuation binds the insurer and prevents you being left with a fraction of your investment after a total loss. Policy conditions usually attach a period of validity to such a report. If it expires, you fall back on market value.

Classic, modern classic and the consequences for acceptance

For classic vehicles, insurers apply separate conditions: a minimum minimum age for the vehicle, a maximum mileage per year, a requirement that you also have an everyday vehicle and sometimes a minimum age for the driver. Modern classics often fall just outside those and are then placed on a regular policy, with market value as the basis. Ask explicitly with your application which arrangement your vehicle falls under and what happens if it falls just outside the age limit.

Import, registration history and documentation

Many classic lorries have been imported. Report that with your application: the provenance, the registration history and any changes to the chassis or body are relevant to acceptance and valuation. If documentation is missing, the chance of discussion when you claim is high. Build a file with the registration certificate, the valuation report, restoration photographs, invoices for parts and maintenance records. When the contract is entered into, the duty of disclosure under Article 7:928 of the Dutch Civil Codeapplies; an incorrect or incomplete statement can cost you the payment under Article 7:930 of the Dutch Civil Code.

What is not covered

The following, among others, are outside the cover: carriage for payment, hiring out and carriage of trading goods; the load and loose items in the load space, because own-damage cover covers only the vehicle; loose parts and restoration stock in the shed, which belong on contents or business contents insurance; and wear, rust and mechanical defects without an external event. The usual exclusions also apply for driving without the required licence, driving under the influence and taking part in competitions, and damage caused by intent or recklessness is excluded under Article 7:952 of the Dutch Civil Code.

What does a valuation report get me?

Certainty about the amount. A valuation by an expert under Article 7:960 of the Dutch Civil Code binds the insurer, so that no discussion arises about market value in the event of a total loss. Without a valuation, a loss adjuster determines the value afterwards and the restoration effort is rarely fully taken into account. Bear in mind that under the policy conditions the report has a limited period of validity and must be renewed in good time.

From what age does my lorry count as a classic?

That differs per insurer and is separate from the tax treatment. Insurers apply their own age limits and also set requirements as to mileage, storage and owning an everyday vehicle. For road tax there is a separate exemption scheme for motor vehicles of forty years and older. Ask with your application which scheme the insurer applies and what conditions come with it.

Are my loose parts in the shed insured?

Not on the lorry policy. That covers the vehicle as described on the policy. A stock of parts, a dismantled engine or a second cab belongs on contents, business contents or goods insurance, depending on the location and use of the space. If you store the vehicle at a third party's premises, report that; some policies set requirements for the storage location.

May I do a house move with my private lorry?

For yourself usually yes, provided the policy does not exclude it. If you do it for someone else in return for payment, it is carriage for payment and falls outside the private cover. Carriage of goods for a business also falls outside it. Also, the household contents being moved are never covered under own-damage cover; separate transit or own-goods cover is needed for that.

My lorry was imported. What does that mean?

Report it with your application. With an import, the specification, chassis number and history sometimes differ from the Dutch reference, which affects acceptance and the valuation when you claim. Make sure the details on the registration certificate, in the valuation report and on the policy match, and keep the import documents in the same file.
