In brief

Personal liability insurance covers damage you cause to another person as a private individual, on the basis of the wrongful act provision of Article 6:162 of the Dutch Civil Code. Added to that are your children, your pets and your home. For damage caused by an animal, the keeper is liable under Article 6:179 of the Dutch Civil Code, even without fault, and for a defective building Article 6:174 of the Dutch Civil Codeapplies: if a roof tile falls from your home onto a parked car, you are liable as the possessor, even if you knew nothing about the defect. The provision that causes the most discussion in practice is the care, custody and control exclusion. Items you have borrowed, hired or been given for safekeeping are not insured while they are in your keeping. The borrowed trailer, the neighbour's drill, the holiday home you rent: if something is damaged, that is in principle at your own expense. Insurers differ here, and some policies offer limited care, custody and control cover or an exception for a rented holiday home. That is exactly what we compare.

The second boundary is with work. Anything you do in the course of a profession or business is excluded under an AVP. If you work as a self-employed person, including part-time or alongside a job, you need a business liability insurance . Also excluded is damage involving a motor vehicle, for which the compulsory third-party liability insurance under Article 2 of the Dutch Motor Insurance Liability Act (WAM) applies, and damage caused by intent or recklessness (Article 7:952 of the Dutch Civil Code).

Who is covered by the family cover

A family policy covers you, your partner and your resident children. Children studying away from home are often still co-insured; a resident parent or a housemate with whom you have no relationship usually is not. For young children, the law also places liability with the parents; check up to what age your policy follows that, and how a house guest or babysitter is dealt with.

Care, custody and control: borrowed, hired or held in safekeeping

The care, custody and control exclusion removes damage to items in your keeping from the cover. That hits precisely the everyday situations: the borrowed pressure washer, a friend's tools, the hired trailer. When comparing policies, ask expressly about the scope of this provision and about any exceptions for rented accommodation.

Helping out a friend

If you help an acquaintance with a house move or a job and something goes wrong, liability law applies a more lenient standard to the helper. Some policies also provide cover for helping a friend which pays for the helper's injury without liability having to be established. That is a real difference between providers, particularly if you regularly help out or are helped out yourself.

What is excluded in any case

Besides profession and business, motor vehicles and items in your keeping, the following are excluded: damage caused by vessels and aircraft above certain limits, damage to your own property and to property of co-insured family members, and fines and penalty payments. Sexual conduct and intentional destruction also stay outside the cover, whoever caused it.

What does your premium depend on?

  • Household composition — single, cohabiting or a family with children

  • Excess — often limited, but available as an option
  • Care, custody and control cover included — a wider provision costs more premium
  • Pets — large or multiple animals count

Frequently asked questions

The questions we are asked most often about this.

Do you always recommend Allianz?

No. We compare several insurers objectively and the choice follows from your situation and the cover you want. With an AVP we look mainly at the definition of the household, the care, custody and control provision and the sum insured. Where personal injury is involved, differences on those points matter more than the difference in premium between providers.

My child causes damage to someone else. Is that covered?

For young children the law places liability with the parents, even if the child cannot be blamed. That claim falls under the family cover of the AVP. As a child gets older, the assessment shifts to the child and the ordinary standards of Article 6:162 of the Dutch Civil Code apply. Resident children and children studying away from home are usually co-insured; check that on your policy schedule.

I have broken something I borrowed. Is that insured?

Usually not. The care, custody and control exclusion removes damage to items in your keeping from the cover, precisely because you were looking after them. Some policies offer limited care, custody and control cover, sometimes only for rented accommodation or places where you stay as a guest. This is one of the most important points to compare in advance, because the situation arises often in practice.

I work part-time as a self-employed person. Is my AVP enough?

No. Everything you do in the exercise of a profession or business is excluded under the AVP, even a small sideline. For those activities you need public and employers' liability or professional indemnity cover. Declare your activities when you apply; Article 7:928 of the Dutch Civil Code requires it and an incorrect statement can cost you the payout.
