A self-employed set-up differs fundamentally from an SME package on one point: there is no staff, so no employers' liability and no sickness absence insurance. What remains therefore weighs more heavily. If you are unable to work, the turnover stops, because there is no one to take the work over.
The liability cover matches what you do. If you work with your hands on a client's property, it is a matter of damage to property under Article 6:162 of the Dutch Civil Code: see liability as a self-employed professional (zzp'er). If you advise, design or calculate, the loss is financial and you need professional indemnity insurance. Many self-employed people do both and therefore need both covers.
Alongside these are two policies that are often put off. Your tools, materials and equipment are insured through business contents and goods. Your income in the event of incapacity is insured through disability insurance, with its own waiting period and its own assessment of your occupation. What to look out for
Four points where a self-employed set-up works out differently from what people expect.
Injury to yourself is nowhere in the liability cover
Liability insurance covers damage you cause to others. If you fall off a ladder yourself or lose the use of a hand, that policy pays nothing. Nor is there an employer to take on the duty of care under Article 7:658 of the Dutch Civil Code; that provision protects employees, not contractors. You arrange your income risk yourself, or you bear it yourself.
Tools left in a vehicle overnight
Almost every policy has a night clause: tools left in a parked van between certain hours are not covered, or only to a limited extent. Also, forced entry to the vehicle is required; a car opened with a key or with a window left open gives no cover. Emptying the van after working hours is not advice but a condition of cover.
Working on the object of the assignment
Damage to the item you are working on at the time falls under the care, custody and control exclusion: the floor you are laying, the engine you are dismantling, the facade your ladder is leaning against. Damage around it is covered. Anyone who regularly works on valuable client property needs additional care, custody and control or working-on cover.
Legal expenses cover has a waiting period and thresholds
A dispute that was already running or foreseeable when the policy was taken out is excluded. In addition there is often a waiting period of several months and a minimum interest below which a case is not taken up. Recovery of unpaid invoices is also far from always included as standard; check that module separately if debtors are your main concern.
What does your premium depend on?
- Your described capacity: the description of the work on the policy schedule is decisive
- Annual turnover: the basis for the liability cover
- Value of tools and equipment: including what stays permanently in the vehicle
- Occupation and waiting period for disability cover: heavy physical work and a short waiting period raise the premium
- Working on site or from home: determines how often you come into contact with other people's property
- Working area: assignments abroad call for a wider territorial limit

Frequently asked questions
This is what people ask us most.
Is my personal liability insurance enough if I am self-employed part-time?
No. A private policy excludes everything you do in the conduct of a profession or business, regardless of how many hours that is. A single paid job alongside employment also falls under it. For that work you need business liability insurance. The private policy continues alongside it for your private life.
My client requires insurance. Which one do they mean?
Usually public and employers' liability insurance, sometimes professional indemnity insurance as well, and for construction work cover for the works themselves. Ask for the exact wording from the contract before you take anything out, including the required described capacity and territorial limit. A policy that only just fails to match the requirement gives you exactly the same problem in a dispute as no policy at all.
I sometimes hire in a colleague. Does that change anything?
Yes. As soon as someone works for you under your direction, the duty of care under Article 7:658(4) of the Dutch Civil Code can come to rest on you as well, even without an employment contract. You are also liable to your client for whatever that engaged person causes. Report the engagement of third parties on the application. It is a circumstance falling under Article 7:928 DCC.
Can I take out disability insurance later?
You can, but the assessment takes place at the time of application. Conditions that already exist are usually excluded or lead to a higher premium. A policy you take out while you are healthy is therefore wider than the same policy a few years later. Declare existing conditions in full; concealment affects the cover under Article 7:930 of the Dutch Civil Code.
