In brief

A marketing agency works largely behind a screen. Strategy, campaigns, content and advertising rarely lead to injury or property damage. That changes as soon as the agency goes out: a photo shoot on location, a stand at a trade fair, a product launch or an activation in a shopping centre. A lighting stand that topples over, a visitor tripping over a cable or a damaged floor in a hired venue are typical claims covered by business liability insurance (AVB).

What business liability insurance does not cover is a professional error. A campaign using an image for which there was no licence, an advert deemed misleading or a wrongly configured ad campaign that burns through a client's budget: that is financial loss. For that you need professional indemnity insurance (beroepsaansprakelijkheidsverzekering), preferably with cover for infringement of intellectual property rights.

Then there is equipment: cameras, lighting and trade fair materials that you hire or borrow fall under the care, custody and control exclusion (opzichtuitsluiting). We map out which activities your agency carries out away from the office, which equipment you use and what requirements clients set, and tailor the cover accordingly.

Independent, personal, sorted quickly

We compare your personal liability insurance (AVP) across dozens of insurers, explain where the real differences lie, and arrange the switch from start to finish — without you having to chase it yourself.

What does your premium depend on?

  • Turnover: the usual basis for calculation
  • Number of employees: including freelancers and students on placement
  • Share of work done on site: shoots, trade fairs and events
  • Type of clients: small and medium-sized businesses or large brands
  • Sum insured: per claim and per year
  • Claims history: previous claims and notifications

Insurers weigh these details differently. That is where your saving is.

Where things go wrong in practice

Four real-life situations that make the difference for a marketing agency.

Lighting stand falls on a visitor

During a product shoot in a showroom, a lighting stand topples over and hits a visitor on the head. The visitor suffers a concussion and holds the agency liable. That injury is covered by business liability insurance, including the costs of defence. Use sandbags, cordon off the set and record who is responsible for setting up. That helps establish liability between the agency, the photographer and the venue.

Trade fair stand and hired floor

While building a trade fair stand, an employee damages the hall floor or a neighbouring stand. The fair organiser recovers the damage from your agency. Damage to the neighbouring stand falls under liability; damage to the hired stand space may fall under care, custody and control and therefore be excluded. Read the stand rental terms, as fair organisers often require liability insurance with a minimum sum insured.

Hired camera damaged

You hire a camera kit worth several thousand euros for a shoot. An employee drops the camera. Because the kit was in your care, the damage falls under the care, custody and control exclusion of the business liability insurance. Rental companies sometimes offer their own cover, often with a high excess. Equipment or electronics insurance, or care, custody and control cover on your policy, can arrange this better.

Image without a licence

A client runs a campaign with a photo your agency took from the internet. The rights holder demands a licence fee and a penalty. The client recovers this from your agency. That is financial loss caused by a professional error and falls outside business liability insurance. Professional indemnity insurance with cover for intellectual property infringement can cover such a claim. Check whether that cover is in your policy.

Frequently asked questions

Questions from marketing agencies about their liability insurance.

Does a marketing agency actually need business liability insurance (AVB)?

For an agency that only works in the office, the physical risk is small. Even so, many clients, trade fair organisers and venue owners ask for proof of liability insurance. And as soon as you organise shoots, events or activations, the risk becomes real. An AVB is relatively inexpensive for office-based businesses. For most agencies, combining it with professional indemnity insurance makes the most sense.

Are freelancers I hire insured?

Freelancers working under your direction may count as subordinates for insurance purposes. Damage they cause to third parties is then covered by your business liability insurance. If a freelancer is injured themselves, you as the principal may be liable for unsafe working conditions. Include hired-in workers in your declaration to the insurer and ask freelancers to have their own policy for their own work.

Is using a drone at a shoot covered?

Usually not. Business liability policies generally exclude damage caused by aircraft, including drones. For commercial drone use you need separate aviation liability insurance, and the pilot must comply with the European drone rules. If you hire a drone pilot, ask about their insurance and proof of qualification. We can help arrange a drone policy if you fly yourself.

What sum insured is usual for an agency?

For a marketing agency, € 1,250,000 or € 2,500,000 per claim is common. Trade fair organisers and large clients sometimes require a minimum of € 2,500,000. For professional indemnity the amount is often lower, depending on the size of the assignments and client requirements. We compare your contracts and stand rental terms with the policy and set the amount at the highest requirement.

What does your cover cost?
