In brief

Klaverblad has cover for the transport of your own goods: goods that are your property and that you move with your own vehicles. That is not word play. A service company takes a faulty appliance back to the workshop, a furniture maker collects a cabinet to restore, a removals company drives someone else's household contents. In all those cases the load is not yours. It comes under the duty of care you owe for other people's property, and property that you have in your care is excluded on a public and employers' liability insurance by the care, custody and control exclusion. Anyone who drives in both directions therefore needs two covers: one for the outward leg and one for the return.

If you do carry for third parties as a business, your position is that of a carrier and your liability is assessed under the carriage conditions you agreed. That liability is limited by weight and rarely provides full compensation. For consignments with a high value per kilo, goods in transit insurance on the goods themselves is the better route. What to look out for

Four questions that determine whether damage to the load belongs on this policy.

Who owns the load at the moment of the loss

Establish for each journey who the owner is. Materials you have bought and not yet delivered are yours. A consignment paid for and delivered to the customer that you are only transporting is not. If your terms state that ownership only passes on payment, that moment shifts. That single sentence determines which policy the loss falls under.

Items being repaired or worked on

Appliances, machines or furniture belonging to customers that you collect come under care, custody and control. They are excluded on liability insurance and they do not belong on own goods in transit cover. There is separate care, custody and control cover, or cover for property in your keeping, for this. Arrange it in advance, because for service companies this is the most common rejection.

Packing, stowage and securing

Damage caused by unsound packing or insufficient securing is excluded, even where the trigger was a covered event. If an unsecured cabinet topples over during an emergency swerve, the swerve is not the cause but the absence of the ratchet strap. If in doubt, photograph how the load stands before you drive off.

Events outside the carriage

The cover runs from taking up to delivery. If the load stands longer in interim storage, a garage or a hired unit, that period usually falls outside it and you need storage cover. Inherent defect, spoilage and normal wear and tear of the goods themselves also remain excluded, as does loss of value without identifiable damage.

What does your premium depend on?

  • Sum insured per journey: the highest value on the road at any one time
  • Type of goods: building materials, furniture or equipment
  • Number and type of vehicles: a closed box truck, an open bed or a trailer
  • Frequency of journeys: daily journeys or occasional carriage
  • Area of cover: the Netherlands, the Benelux or wider Europe
  • Excess chosen: per event, often separately for theft

Frequently asked questions

This is what people ask us most.

I collect appliances from customers. Is that own transport?

No. Those appliances remain the customer's property and are in your keeping. If you damage them on the way, you are liable to the owner, but liability insurance excludes damage to property in your care. For that you need separate cover for third-party property in your keeping, with its own sum insured.

What if I drive both for myself and for clients?

Then two regimes run alongside each other and one policy is not enough. For your own goods, own goods in transit cover is enough. For carriage on behalf of others, your liability is assessed under the agreed carriage conditions. State on the application how the two are balanced, because that determines acceptance and premium.

Does the cover apply during loading and unloading?

Usually yes, provided the loading and unloading is done by or under the supervision of the insured and is directly connected with the carriage. If a pallet falls off the tail lift, that is covered. If it happens hours later while things are being installed at the final destination, the carriage has already ended. Read on the policy schedule exactly where the start and end moments lie.

Do I have to report a change in my goods?

Yes. If you start carrying substantially different or much more valuable items, report it before the first journey takes place. The duty of disclosure of Article 7:928 of the Dutch Civil Code applies when the insurance is taken out, and Article 7:930 DCC governs what happens if the insurer would have imposed different conditions, or would not have accepted the risk, had the information been correct.
