It concerns damage to your own property during carriage. If you carry cargo for a client, you need something else: carriers' liability insurance under the AVC or CMR conditions.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Your own property, not your liability as a carrier

This is property cover on your own possessions: nobody has to be liable. If you carry someone else's goods for payment, there is a liability question and the carriage conditions apply, with quite different liability limits. That third-party cargo is excluded on an own goods in transit policy. If you are unsure what you are carrying, look at the order confirmation: if carriage appears in it as a separate service, you are a carrier.

Tools left in the van overnight

Virtually every policy has a clause on this: the van must be properly locked, often kept indoors or on a locked site, sometimes with a prescribed alarm class. If that clause is not complied with, no payment follows after a theft, however genuine the loss. Theft without signs of forced entry is almost always refused. Tools you leave on the building site fall outside this cover in any event.

Loading, unloading and securing the load

Whether damage during loading and unloading is included is a separate module with many insurers. If something falls off the vehicle, the next question is whether the load was properly secured: damage from insufficient packing, stowage or securing is excluded as standard. If you damage the consignee's premises or property while unloading, that is liability and runs through your public and employers' liability insurance (AVB), not through this policy.

What is never covered

Money, securities, telephones and means of payment are excluded or insured only under a separate provision. The same applies to damage from inherent defect, rust, wear and tear or the effect of temperature in unrefrigerated carriage. Damage caused deliberately is excluded under Article 7:952 of the Dutch Civil Code. Report a claim as soon as you know of it: Article 7:941 DCC obliges you to do so, and reporting late can prejudice the insurer in its investigation.

What does your premium depend on?

  • Sum insured per means of transport. The maximum value in a van or trailer at any one time is the main basis of calculation.
  • Number and type of vehicles. A fleet of vans is assessed differently from a single van with a trailer.
  • Nature of the goods. Power tools prone to theft weigh more heavily than bulk materials or scaffolding parts.
  • Working area. The Netherlands only, the Benelux or the whole of Europe makes a difference to the premium and to the clauses that apply.
  • Security and overnight storage. Indoor storage or a locked site brings the premium down; parking in the street does the opposite.
  • Excess and claims history. Previous thefts from the van weigh heavily. A higher excess lowers the premium.

What is the difference from goods in transit insurance?

Own goods in transit insurance covers property that belongs to you and that you move with your own vehicles. Goods in transit insurance is used where goods are carried by a third party or where you dispatch trade goods and bear the transit risk. If you carry for a client for payment, you need carriers' liability insurance. Those three forms are not interchangeable.

Are my tools insured if they stay in the van?

Only if you comply with the overnight storage clause. That generally requires the van to be properly locked and kept on a locked site or indoors, sometimes with a prescribed alarm. If that is not met, or there are no signs of forced entry, the theft is rejected. So have it recorded exactly which requirement is on your policy.

Does this insurance also cover damage to the van itself?

No. The van is a motor vehicle and belongs on the commercial motor policy; its third-party liability cover is also compulsory under Article 2 of the Dutch Motor Insurance Liability Act (WAM). Own goods in transit insurance relates solely to the goods you carry. In a collision that damages both the van and the load, there are therefore two claims under two covers.

Does the cover also apply abroad?

That depends on the area of operation stated on the policy. The standard is often the Netherlands or the Benelux; wider cover within Europe is usually possible but has to be applied for. If you occasionally cross the border for a job, report that in advance. A loss outside the stated area is not paid, even if the policy is otherwise in order.
