Is everyone insured in the Netherlands?

No. Everyone living here comes under the duty to have health insurance and every motor vehicle has to have third-party liability cover, but beyond that there is no general obligation to insure. Below you can read what that means.

Vermeld het jaar, wat er speelde en hoe het is afgehandeld. Dit betekent niet automatisch dat je niet verzekerd kunt worden.

In brief

Two obligations apply to everyone who falls under them. The health insurance is compulsory for anyone living in the Netherlands or paying wage tax here. The government checks this and takes action against the uninsured. The second is the Third-party liability cover for motor vehicles from Article 2 of the Dutch Motor Insurance Liability Act (WAM): as long as a registration is in your name and has not been suspended, there has to be at least liability cover, even if the vehicle is not being driven.

There are also obligations that come not from the law but from a contract. With a mortgage a lender almost always requires buildings insurance for the security, and clients regularly ask self-employed professionals for public and employers' liability or professional indemnity insurance. Such requirements are set out in the deed or in the agreement, not in the law.

All other cover is voluntary, and not everyone has it. There are households without liability or home contents insurance, and there are people driving uninsured or without health insurance. That rarely goes without consequences: fines, recovery by the Waarborgfonds Motorverkeer and an administrative premium. See also the two compulsory insurances.

Two points showing why having a policy is not the same as being protected.

Driving uninsured always comes back to you

The victim of a collision with an uninsured vehicle can turn to the Waarborgfonds Motorverkeer. That fund pays the loss, but then recovers it in full from the person who caused it. On top of that comes the penalty for breaching Article 2 of the Dutch Motor Insurance Liability Act (WAM). Something similar applies to your home: as owner you are liable under Article 6:174 of the Dutch Civil Code for defects in your building, insured or not.

A policy always has limits

Being insured is not the same as being covered for everything. Permanently excluded are intent and recklessness (Article 7:952 of the Dutch Civil Code), wear, deferred maintenance and design faults, damage from profession or business on a private policy, and disputes already running before the legal expenses cover started. Anyone withholding information when taking out the policy runs into Articles 7:928 and 7:930 of the Dutch Civil Code and in effect is left with a policy without cover.

What does your premium depend on?

  • Postcode area: burglary, storm and water risk

Can I live in the Netherlands without health insurance?

Not without consequences. Anyone living here or paying wage tax is obliged to insure. The uninsured are traced and first receive a reminder, then a fine and ultimately an administrative premium withheld from their income. In the meantime you pay all healthcare costs yourself. If you have just come to live in the Netherlands, arrange it within the statutory period.

Is liability insurance compulsory?

For private individuals, no. You are, however, liable yourself under Article 6:162 of the Dutch Civil Code for damage you cause unlawfully, and with personal injury that runs high. For the keeper of an animal there is also the strict liability of Article 6:179 DCC: you are liable for damage caused by your dog or horse, even without any fault of your own.

Am I insured while abroad?

That depends on the area of cover. Liability and home contents cover normally applies worldwide or in Europe with limitations, and car insurance applies in the countries on the green card. Healthcare costs are not always reimbursed in full outside the Netherlands. Check the area of cover and the maximum period of stay on each policy before you go away for a longer time.

What if someone else damages my car while uninsured?

If the person responsible is known but uninsured, you can turn to the Waarborgfonds Motorverkeer. That also applies, subject to conditions, where the person responsible is unknown. If you have own-damage or comprehensive cover yourself, your own insurer usually settles the claim and tries to recover the amount. In both cases report the matter to the police and notify the claim as soon as possible.
