In brief

Two types of insurance are required by law in the Netherlands. Everyone who lives or works here takes out basic health insurance under the Health Insurance Act. That has to be done within four months of arrival or registration, backdated to that date. And anyone who has a motor vehicle in their name is required to take out Third-party liability insurance under Article 2 of the Dutch Motor Insurance Liability Act (WAM), for as long as the registration is not suspended. All other insurance is voluntary, even though a mortgage lender, landlord, VvE (Dutch owners' association) or client can require it by contract.

The customary package alongside that consists of buildings, home contents, personal liability, legal expenses and travel insurance. Liability insurance is common in the Netherlands because liability law under Article 6:162 of the Dutch Civil Code reaches far: parents are strictly liable up to a certain age for damage caused by their children, keepers of animals for damage caused by their animal (Article 6:179 of the Dutch Civil Code) and owners of a building for defects in it (Article 6:174 of the Dutch Civil Code). Personal injury claims can run high here and there is no statutory maximum.

Supervision is divided: DNB looks at the financial soundness of insurers, the AFM at conduct and the information provided, both under the Dutch Financial Supervision Act. Before you take out cover you receive an insurance card (verzekeringskaart): a standardised one-page summary. If you cannot resolve matters with an insurer, a complaint goes first to its internal complaints procedure and then to Kifid or the courts. On general insurance you pay 21% insurance premium tax; on life and health insurance you do not.

Buildings insurance is not required by law, but almost every mortgage lender makes it a condition in the mortgage deed.

Two points about the Dutch system

Supervision and standardisation make comparison easier, but they change nothing about the exclusions.

Your rights in a dispute

Insurers and advisers are supervised by DNB and the AFM under the Dutch Financial Supervision Act. Before you take out cover you receive an insurance card (verzekeringskaart) and the policy conditions. With insurance taken out at a distance there is usually a a cooling-off period of fourteen days. If an insurer refuses a claim, ask in writing for the provision it is based on. If you disagree, you first go through the internal complaints procedure and can then go to Kifid or the courts. As regards the size of the loss you can instruct your own an independent loss adjuster acting for you; those costs are reimbursed within limits.

What is not covered in the Netherlands either

The system is well organised, but it has firm limits. Not covered on ordinary home policies is flooding caused by the failure or overtopping of a primary flood defence; that risk lies partly with the government under the Disaster Damage Compensation Act. Also, the exclusions for intent and recklessness (Article 7:952 of the Dutch Civil Code), for wear, deferred maintenance and design faults, for earthquake and volcanic eruption, and for nuclear reactions and war risksapply everywhere. Dutch policies also have a area of cover: outside the Netherlands cover is often limited to the countries on the green card or to Europe. Anyone staying abroad for a long period has to report that.

What does your premium depend on?

I have just moved to the Netherlands. What do I have to arrange first?

Basic health insurance. It is compulsory for everyone who lives or works here and has to be arranged within four months of registration, backdated to the date of arrival. If you also put a car in your name, third-party liability insurance is compulsory immediately. After that comes the customary package: home contents, liability and possibly legal expenses.

Is liability insurance really necessary in the Netherlands?

It is not compulsory, but it is the policy with the most lopsided relationship between premium and risk. Personal injury claims have no statutory maximum in the Netherlands and can run for decades in loss of earning capacity and care costs. On top of that, as a parent, animal keeper or building owner you are liable in certain cases even without fault of your own.

What is the insurance card (verzekeringskaart)?

A standardised one-page summary that you receive before taking out cover, setting out the main covers, exclusions and amounts under fixed headings. That makes policies from different insurers comparable. Note: when you claim, the policy conditions and the clauses on your policy schedule govern, not the card.

Does my Dutch policy also apply abroad?

Limited. Motor insurance applies in the countries listed on the green card. Home contents and liability policies usually have limited cover away from home, often within Europe and for a limited period. If you stay abroad for longer, let the property or leave it empty, report that; otherwise cover can lapse.
