In brief

The law imposes two insurances on private individuals. Anyone who lives in the Netherlands or pays wage tax here is required to take out health insurance under the Health Insurance Act. Anyone with a motor vehicle in their name has to insure it Taking out third-party liability insurance under Article 2 of the Dutch Motor Insurance Liability Act (WAM). Beyond that there is no statutory insurance obligation for private individuals.

There are also obligations that come not from the law but from a agreement. A mortgage lender requires buildings insurance, a tenancy agreement can require glass or liability cover and a client often requires public and employers' liability insurance. Some professions are also subject to a statutory requirement to hold professional indemnity insurance, for financial advisers under Article 4:75 of the Financial Supervision Act, for example.

Two things that are often missed

Part of your cover is not arranged by you, and a compulsory policy covers far from everything.

Insured without taking anything out

Besides the policies you take out yourself, you are insured by operation of law through the national insurance schemes AOW, Anw and Wlz and, as an employee, through the employee insurance schemes unemployment, WIA and sick pay. There is no policy and no choice: the contribution runs through wage tax. The self-employed fall outside the employee insurance schemes; their income risk during illness is uninsured as long as they have no disability insurance (AOV).

What the compulsory policies do not cover

Health insurance pays only for care in the basic package, after your statutory excess; dental care for adults, glasses and most physiotherapy fall outside it. Third-party liability cover pays only for damage to others, never to your own vehicle, and not where there is driving without a valid licence, under the influence or during races. Damage caused by intent or recklessness is excluded under Article 7:952 of the Dutch Civil Code.

I work in the Netherlands but live across the border: do I have to be insured here?

In many cases yes. The obligation to take out health insurance is linked to being insured under the Long-Term Care Act, and anyone employed in the Netherlands usually is. European coordination rules determine which country has jurisdiction. With cross-border work, have this established in advance, because being insured twice or not at all costs money.

Do I have to have disability insurance as a self-employed professional?

Not at present. The self-employed fall outside the employee insurance schemes and bear the income risk during illness themselves. Legislation is being prepared for compulsory basic disability cover for the self-employed; as long as that has not come into force, disability insurance (AOV) or joining a mutual support fund remains your own choice.

Is home contents insurance compulsory?

No, for nobody. A landlord can, however, require in the tenancy agreement that you have liability or glass cover, and VvE regulations can determine what is insured jointly. Those are contractual arrangements. If you fail to comply, that is a breach of contract towards the other party and not a breach of the law.

Do I have to insure anything as an employer?

There is no compulsory employer's insurance. You do have an obligation to continue paying wages during illness and liability for the safety of your employees under Article 7:658 of the Dutch Civil Code. Many employers cover those risks with sickness absence insurance (verzuimverzekering) and employer's liability cover, but that is a choice, not an obligation.
