In brief

The paint shop determines your acceptance. Paint, thinners and cleaners are flammable, so are their vapours, and drying takes place under heat. Insurers therefore include clauses on the spray booth, the extraction system, periodic inspection and the separate storage of solvents with a maximum quantity. Keep the booth's inspection reports; they are the first thing requested after a fire.

The second feature of accident repair is waiting time. Vehicles wait for parts, for the insurer's approval or for a loss adjuster's inspection, and in the meantime they stand in your building or on your site. All that time you have them in your in your care. The limit must match the amount of vehicle value present at the busiest moment, including whatever stands outside the gate.

The work is changing as well. Bumpers, windscreens and mirrors carry radar and camera sensors that have to be recalibrated after repair. An error there only comes to light at the next emergency stop. We include that as a separate activity when building your garage insurance.

What does your premium depend on?

  • Spray booth and inspection status. Presence, type and the date of the last inspection of the booth and extraction system.
  • Quantity of paint and solvents stored. Litres per type and how they are stored separately in fire-resisting conditions.
  • Vehicle value indoors and outdoors. The peak in customer vehicles determines the care, custody and control limit needed, with the outdoor site assessed separately.
  • Size of the courtesy car fleet. Number of courtesy cars, the user profile and the excess applied.
  • Calibration and glass repair carried out in house. Work on driver assistance systems increases the chance of consequential damage after handover.
  • Annual turnover and payroll. Repair hours, panel and paint turnover and the number of staff form the basis.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Booth, extraction and storage are clauses

The policy schedule sets requirements for the spray booth, for the operation and maintenance of the extraction system and for the separate, fire-resisting storage of paint and solvents, with a maximum in litres. If you work above that maximum or keep the store in the workshop, you are departing from the situation declared. Keep inspection reports and maintenance invoices; after a fire they are your only evidence of compliance.

The outdoor site counts

Vehicles waiting for parts often stand outside, sometimes for weeks. They still belong to your customer and are in your care, but the outdoor site is a separate risk item: hail, storm, vandalism and theft of catalytic converters or parts. State how much vehicle value stands outside at most and whether the site is fenced, lit and covered by cameras; otherwise the limit is calculated on the indoor space alone.

Calibration of driver assistance systems

After a bumper, windscreen or mirror is repaired, the radar and camera have to be realigned. If that calibration is out, an emergency braking assistant or lane assist works incorrectly and causes consequential damage that has nothing to do with panel work. You are then acting carelessly within the meaning of Article 6:162 of the Dutch Civil Code. Record for each vehicle which calibration was carried out, with what equipment and to which manufacturer's procedure.

Replacement transport is a fleet of your own

Courtesy cars are motor vehicles and therefore fall outside the liability section. The compulsory cover of Article 2 WAM applies to them. Changing, often unknown drivers make the claims experience erratic. For each issue, record the driver, the driving licence, the mileage and the excess, and check whether young drivers are permitted under the policy conditions.

Are customer vehicles on the outdoor site covered?

Only if the outdoor site has been declared as a storage location and falls within the care, custody and control limit. Insurers often impose requirements on fencing, lighting and camera surveillance. Because waiting times for parts can grow, there are sometimes weeks when more value stands outside than inside. Have the limit calculated on that peak and not on the annual average.

What does the insurer ask for after a fire in the paint shop?

As a rule the inspection reports for the spray booth, the maintenance history of the extraction system and the record of quantities of paint and solvents stored. Those documents show whether you complied with the clauses on the policy schedule. If you cannot produce them, a dispute about compliance arises and the payment can be reduced.

Is soil contamination by solvents covered?

Not on liability or fire insurance. Contamination of soil, water or air and the remediation costs that follow belong to environmental damage insurance. That is a separate policy with its own limit and its own conditions on drip trays and liquid-tight floors. Without that policy you bear the remediation costs yourself.

Who is liable if a calibration is wrong?

You are, if the calibration formed part of your instructions and was not carried out to the manufacturer's procedure. The consequential damage from a driver assistance system that works incorrectly can be considerable and falls under the liability cover in principle. Carrying out the calibration again is putting your own work right and remains for your own account.
