In brief

On a business policy the declared use is the pivot. Private, commuting, business travel and delivery are four different classes each with its own rate. If the machine is in fact carrying parcels or meals around while private use appears on the policy, the actual risk departs from the declaration and the insurer can rely on Articles 7:928 and 7:930 of the Dutch Civil Code.

If the machine is registered to the business and staff ride it, a second layer is added. For damage an employee causes to third parties, the employer is liable under Article 6:170 of the Dutch Civil Code. For injury to the employee himself, the duty of care in Article 7:658 DCC and the good employer standard of Article 7:611 DCC apply.

Not covered on the motorcycle policy: goods and tools carried, damage during hire or riding lessons, and damage caused by a rider without valid entitlement. See also the general motorcycle insurance.

What does your premium depend on?

  • Class of use. Commuting, business travel or delivery. On a business policy this is the heaviest factor.
  • Number and age of the drivers. An open rider clause weighs more heavily than a policy with one named rider.
  • Annual business mileage. Kilometres covered on instructions count differently from recreational kilometres at the weekend.
  • Value excluding or including VAT. Businesses registered for VAT usually insure exclusive of VAT. That makes a difference to the basis.
  • Sector and area of operation. Urban delivery traffic is assessed differently from a field service making regional trips.
  • The company's claims history. With a business policy, the claims record of the business counts, not your private history.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Delivery is a risk class of its own

A machine that stops, pulls away and double-parks in city traffic every day has a different pattern of loss from a commuting machine. Meal and parcel delivery therefore form a separate class with their own rates and sometimes their own underwriting policy. If you ride on a policy with private use, that is a ground for refusal when a claim is made. Also report temporary use, for example during a peak period, because that changes the risk just as much.

Injury to your employee: Articles 7:658 and 7:611 DCC

If an employee rides in the course of the work, you bear the duty of care in Article 7:658 of the Dutch Civil Code and, for taking part in traffic, the standard in Article 7:611 DCC that you arrange proper insurance. The third-party liability cover on the motorcycle policy pays third parties only, so the rider's own loss falls outside it. An indemnity policy for occupants is needed for that.

Damage caused by a subordinate lands with the business

If an employee causes a collision with the company machine, the business is liable under Article 6:170 of the Dutch Civil Code. Recovery from the employee is virtually impossible: Article 7:661 DCC allows it only in cases of intent or deliberate recklessness. Beyond that, the insurer recovers nothing from you as long as the declaration is correct, but it does where the rider held no valid licence. The injured party then remains protected through Article 2 of the Dutch Motor Insurance Liability Act (WAM).

A machine owned by the business: VAT, riders and no-claims years

On a business policy there is the question of whether the sum insured is taken with or without VAT. If you are registered for VAT, settlement is usually exclusive of it. Also record who may ride, because an open rider clause costs more than a named group. Finally, note that no-claims years on a business policy do not automatically transfer to a private policy when the business closes.

Does business use have to appear on the policy?

Yes. The use declared determines the premium and the underwriting, and a difference between declaration and reality gives the insurer room under Article 7:930 of the Dutch Civil Code to reduce the payment. That applies to temporary business use as well. Report the change in writing and ask for confirmation on the policy schedule, so that no argument arises afterwards.

Who is liable if my employee causes a collision?

The business, under Article 6:170 of the Dutch Civil Code for the acts of subordinates. The third-party liability cover on the motorcycle policy settles the other party's loss. Recovery from the employee himself is virtually ruled out: Article 7:661 DCC allows it only in cases of intent or deliberate recklessness, and that threshold is rarely met.

Is my employee's own loss covered?

Not under the third-party liability cover, because that pays third parties only. For injury and property damage to the rider himself, an indemnity policy for occupants is needed. For employers that is more than a choice: Article 7:611 DCC requires you to arrange proper insurance for employees who take part in traffic in the course of their work.

Can I use business no-claims years privately later on?

Not automatically. No-claims years built up in a business's name are registered against the legal entity, not against you as an individual. On the business closing or a move to private use, one insurer will take them over and another will not. Ask about it in advance and have the undertaking recorded in writing before you end the policy.
