In brief

Please note: borrowing money costs money. Business credit takes many forms: an overdraft facility for working capital, a loan for an investment, leasing of business assets or factoring of your receivables. Each form has its own price and its own security requirements.

For consumer credit the annual percentage rate (APR) is required by law and makes offers comparable. The monthly payment does not. For business credit that requirement does not always apply. So ask expressly for the effective rate per year and for all additional costs, including the arrangement fee and management charge.

Where things go wrong in practice

Four points on which business owners are caught out with finance.

Business credit has less statutory protection

The rules on credit information, the APR and assessment are written for consumers. For purely business finance they largely do not apply. So ask yourself for a full cost overview: interest, arrangement fee, management costs, early repayment costs and what happens if you miss an instalment. Set those documents side by side before you sign.

A guarantee reaches your private assets

Lenders often ask for a a personal guarantee or joint and several liability of the director and major shareholder. With a sole trader or a partnership your private assets are liable in any event. Read exactly what the guarantee covers and whether it lapses once the credit is repaid. That is not a given.

The lender requires insurance, but does not read the policy

The credit agreement usually states that the buildings, contents and sometimes business interruption must be insured, with the lender as beneficiary. Whether the sums insured are correct remains your responsibility. If they are too low, underinsurance follows and losses are paid proportionately. Also disclose changes in activities. The duty of disclosure of 7:928 DCC applies in full.

Our role is limited and we say so

We do not provide credit, do not broker it and recommend no lender. Where we refer you to an external party, a fee may be payable for that. You are free to choose for yourself. For your business insurance we are indeed your adviser.

What to look out for when comparing

  • Effective rate per year: ask for it, because with business credit the APR is not always compulsory
  • Total cost of credit: interest plus arrangement fee, management costs and administration costs together
  • Security: a pledge over stock and receivables, a mortgage right or a personal guarantee
  • Penalty-free repayment: ask in advance what early repayment or refinancing costs
  • Conditions during the term: agreements about figures, ratios and information duties can limit your room for manoeuvre
  • Licence and membership: check the provider and the adviser in the AFM register and with a disputes body

Does Finass Verzekert arrange business finance?

No. Our AFM licence covers general insurance; finance falls under other licence categories. We refer you to firms registered for it. What we do alongside the finance is the insurance part: liability, buildings, contents, stock, business interruption and the vehicle fleet, including the policy your lender requires.

Does the annual percentage rate also apply to business credit?

Not always. The statutory APR requirement is written for consumer credit. For business finance you have to ask for the effective rate per year and the additional costs yourself. Do that in the same way with every provider, otherwise you are comparing offers that are not comparable and choosing on the monthly payment.

Is my business application checked against the BKR?

Licensed providers consult the BKR for credit from 250 euros with a term longer than one month. For purely business finance the lender's own assessment weighs most heavily: annual figures, forecasts, security and your payment record. With a sole trader or a partnership, lenders usually also look at your private situation.

Why does my lender require particular insurance?

Because the security and the continuity of your business form its security. If the premises burn down or production stops, the source of repayment disappears while the debt remains. That is why almost every agreement contains an insurance obligation, often with the lender as beneficiary on the policy.

What happens if I cannot pay an instalment?

Tell the lender yourself and in good time. It can usually consider a deferral or an adjusted schedule with you. If you wait until the loan is called in, it can enforce its security and, where there is a guarantee, reach your private assets as well. Record every agreement in writing, even one made by telephone.
