In brief

The business contents of a bakery consists of the oven, the proving cabinet, the dough mixer, the finishing table, the refrigeration and the fit-out of the sales area. You insure that item at replacement value as new. Flour, butter, filling and finished product are goods and are covered at purchase or cost price. Both amounts appear separately on the policy, and in a bakery in particular the goods item rises sharply around the holidays.

The risk that sets a bakery apart from other businesses is heat combined with dust. Grease deposits and flour residues in the extraction duct above the oven are a well-known cause of fire, and fine flour dust can lead to a dust explosion if there is a source of ignition. Insurers therefore put clauses on the policy about cleaning the ducts, about how the electrics are installed in dust zones and about the separation between the baking area and the retail space.

Outside the cover remain: an oven that fails through inherent defect, the gradual effects of heat and steam on the fittings, spoilage of dough, cream and filling without the spoilage section, and money from the till. What you declare on application about extraction and the cleaning regime falls under the duty of disclosure in Article 7:928 of the Dutch Civil Code.

What does your premium depend on?

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Dust extraction determines whether you are accepted

Fine flour dust settles on pipework, light fittings and the tops of machines. Insurers therefore set requirements for extraction, for how the electrics are installed in dust zones and for how often the ducts above the oven are cleaned. Those requirements appear as a clause on your policy. Keep the cleaning reports with date and company name: after a fire the loss adjuster asks for them first, and without a report the insurer will rely on the clause.

A broken oven is not fire damage

If the controls, a heating element or the circulation fan of the oven fail, that is inherent defect and not an insured peril. This insurance pays for fire, lightning strike, burglary and water, not for a machine that fails of its own accord. If you want that covered too, that calls for machinery breakdown insurance. Combine it with business interruption cover, because a bakery without a working oven produces nothing at all.

The goods item peaks around the holidays

Flour, butter, almond paste and finished product are at a multiple of the annual average in November and December. A sum insured based on an average week then means underinsurance: payment is proportionate, even for a small claim. Declare the peak in advance or agree a higher goods item for those months. In any event no more than the actual loss is paid; that follows from Article 7:960 of the Dutch Civil Code.

Night work, spoilage and what falls outside

Bakers work at night and the shop is open during the day, so the premises are rarely unattended at the standard times. Report that, because alarm settings and supervision requirements are matched to it. Also outside the cover: spoilage of dough, cream and filling after refrigeration failure without the spoilage section, money in the till, and orders customers left with you. The last of these is third-party property and calls for its own section.

Is damage from a dust explosion covered?

Explosion is usually an insured peril, but the cover stands or falls on the clauses about dust extraction, cleaning and electrics in dust zones. If you demonstrably comply with them, the loss falls under the policy. If the cleaning regime is missing, the insurer relies on the clause. So record cleaning and maintenance with the date and who carried it out.

Is spoilage of dough, cream and filling included?

Only with the spoilage section. Conditions attach to it: a temperature alarm, a minimum duration of failure and demonstrable records. Also note the difference between a fault in your own refrigeration plant and a failure of the public supply. Not every policy covers both. Without that section, spoiled stock is not paid for, not even after an insured fire elsewhere in the building.

Do I bake at a different address from where I sell?

Then both addresses must appear on the policy. Business insurance covers the business contents and goods at the risk address stated. If you produce in a bakery on the edge of the village and sell in a shop in the centre, that is one business but two risks, with its own sum insured and its own security requirements per location.

The oven caused a fire. Is the oven itself paid for?

The fire damage to the bakery is covered, and usually also the damage the fire caused to the oven itself. The defect that caused the fire is not: a burnt-out heating element or broken controls is inherent defect and remains outside the cover. That distinction is precisely why machinery breakdown cover is taken out alongside this policy.
