In brief

Public and employers' liability insurance (AVB) covers property damage and personal injury that you, your staff or a hired-in worker cause to someone else. The legal basis is the tort provision of Article 6:162 DCC; for the mistakes of subordinates Article 6:170 of the Dutch Civil Code applies, and for non-subordinates you engage Article 6:171 DCC. That is why this policy also covers liability for the agency worker in your team and for the subcontractor you present to the outside world.

What the AVB does not do in principle is pay for pure financial loss: loss arising without anything being broken or anyone being injured. Wrong advice, a calculation error in a budget, a missed deadline. That risk belongs with the professional indemnity insurance, which runs alongside the AVB and is not part of it.

What does your premium depend on?

  • Nature of your work. Assembly at third parties' premises or work on existing installations weighs more heavily than work carried out entirely in your own workshop.
  • Wage bill and hired-in workers. The employers' liability section works with the number of people on the floor, including agency workers and self-employed professionals.
  • Level of the care, custody and control limit. A higher limit for property in your care is the most expensive individual choice on this policy.
  • Work after completion included or not. This module extends your exposure after the job is finished and is priced separately.
  • Sales area for your products. Supplying outside Europe, and certainly to the United States and Canada, changes the risk assessment entirely.
  • Claims history per section. Insurers look not at the total but at whether the claims arise from property in your care or from injury.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Care, custody and control: damage to what you have in your care

The main cover excludes damage to property you hire, work on, transport or otherwise have in your care. If your client's machine falls over while your engineer is working on it, that is not damage to a random third party but damage to property in your care. Only the care, custody and control module brings that back within cover, with a limit of its own that is almost always lower than the sum insured. We test that limit against the value of what you actually have in your hands.

Work after completion covers the consequential loss, not your own work

If your coupling turns out to be leaking months later, the module pays for work after completion the wet floor and the damaged stock underneath. The cost of remaking the coupling itself is not covered: repairing or replacing the defective work remains at your expense. The same applies to a product supplied with an inherent defect. The distinction between the item itself and the damage around it determines what is paid here.

Staff who are injured go through Article 7:658 of the Dutch Civil Code

For loss suffered by your own employees, the duty of care under Article 7:658 DCCapplies: you have to show that you took the necessary measures, rather than the employee having to show that you fell short. That liability falls under the employers' liability section of the AVB. Road accidents during working hours also run through Article 7:611 DCC and are far from always covered by that section. There is a separate road risk cover for that, which we quote separately.

What stays outside the policy

Excluded are damage caused with or by a motor vehicle, which belongs with the compulsory cover under Article 2 WAM, and damage caused deliberately, which Article 7:952 DCC confirms. Soil and water pollution is not included either. That is the province of the environmental damage insurance. Fines, penalty payments and liability accepted by contract that goes further than the law requires do not fall under it either.

This is what people ask us most.

What exactly does care, custody and control mean?

It refers to property that is not yours but is in your keeping: hired plant, a machine you are repairing, goods you transport or store. The basic cover excludes damage to it, because the risk is then no longer a matter of chance but is connected with what you do with the item. The module brings it back within a lower limit of its own.

My subcontractor makes the mistake. Who is held liable?

Your client will usually hold you liable, because you entered into the contract. Article 6:171 of the Dutch Civil Code makes you liable for the mistakes of non-subordinates carrying out your business activities. Your AVB deals with the claim and then seeks recovery from the subcontractor's liability insurer. Check, therefore, whether your subcontractors are insured themselves and whether their cover is not lower than yours.

Does the AVB pay for redoing my own work?

No. The cost of putting right, removing and remaking defective work is a business risk and appears as an exclusion in almost every policy. What the insurance does pay for is the damage that the defect causes elsewhere: the soaked floor, the damaged installation next to it, your client's business interruption to the extent that it can be attributed to you.

Do I need professional indemnity insurance as well as the AVB?

That depends on whether you also supply advice, design, calculations or inspections. If something goes wrong in that thinking work, there is financial loss without anything being broken, and that is precisely the form the AVB excludes. Businesses that both carry out work and advise need both policies; we will determine with you where the dividing line lies in your assignments.
