In brief
Finass is an independent broker and has no interest in any one insurer. We compare several insurers objectively and the choice follows from what you need in terms of cover: which activities are entered in the trade register, which clients you work for, how many staff you have and what cover your contracting parties require. Nationale-Nederlanden has a broad business range, which means liability cover can sit with the same insurer as, for example, the Construction all risks (CAR) insurance, the erection all risks insurance or the environmental damage insurance.
That last point is more than an administrative convenience. Losses in construction and installation engineering often land on the boundary between two policies: is it defective work, is it consequential loss to a third party, or is it damage to the works themselves? If those policies sit with one risk carrier, the discussion about who pays is shorter. What the liability cover provides is set out on the hub page public and employers' liability insurance.
The boundary always lies in the described business activity on the policy schedule. That wording determines which activities you are insured for. If you expand into assembly, maintenance or advisory work, report it. The duty of disclosure when the policy starts follows from Article 7:928 of the Dutch Civil Code and a misrepresentation can affect the payment through Article 7:930 of the Dutch Civil Code. On these policies the premium is usually based on turnover or the wage bill, with an adjustment after the end of the insurance year.

What falls outside the cover
Excluded are, among others pure financial loss without injury or property damage, damage caused with or by a motor vehicle (Article 2 of the Dutch Motor Insurance Liability Act (WAM)), property that you in your care has, the cost of repairing or replacing your own defective work or product, and fines and penalty payments. Intent and wilful recklessness remain excluded on the basis of Article 7:952 of the Dutch Civil Code.
Employers' liability and road use
Injury to your own and hired-in staff falls under a separate section. Your duty of care follows from Article 7:658 of the Dutch Civil Code, and subsection 4 includes agency workers and self-employed professionals working under your direction. If staff drive for work, additional cover is needed. The difference is explained under WEGAS and WEGAM.
Claims-made or occurrence basis
Many Dutch liability policies work on a claims-made basis: what counts is the moment the claim is made, not the moment of the mistake. So when you switch, you have to look at run-in cover for past acts and at a run-off period after termination. Without those arrangements there is a gap that only becomes visible years later.
Abroad and export
If you supply customers outside Europe or work at locations abroad, look at the territorial scope and at the usual exclusion for the United States and Canada. That exclusion applies with virtually every Dutch provider and can only be lifted with a separate clause.
What does your premium depend on?
- Annual turnover: the usual basis, with an adjustment afterwards
- Payroll: counts towards the employers' liability section
- Described business activity: different rates apply to different activities
- Sum insured: per claim and per insurance year
- Excess: a higher excess per claim brings the premium down
- Claims history: the record of the past few years counts towards acceptance

The dividing line lies in the nature of the loss: injury and property damage belong on the AVB, loss without any identifiable damage on the BAV.

Why should I insure with this insurer in particular?
That is not a starting point but an outcome. We put the application out to several insurers and assess conditions, clauses, excess and premium side by side. Nationale-Nederlanden comes into the picture when the broad business range suits a company that needs more than one business policy and wants to limit overlapping cover.
Can I have my existing policy transferred?
You can, but not without checking the term and the notice period of your current contract. More important still is the join: do not leave past claims uninsured, by arranging run-in and run-off cover. For that we ask for your current policy schedule, the clauses and a claims history.
Does this insurance cover a mistake in my advice?
No. Wrong advice or a wrong calculation leads to financial loss without anything being broken or anyone being injured. That is pure financial loss and it belongs on a professional indemnity insurance. Both covers can be taken out separately and they dovetail with each other.
When do I have to report a claim?
As soon as you know of the loss or of a claim. Article 7:941 of the Dutch Civil Code requires you to report as soon as that is reasonably possible; reporting late can prejudice the insurer in the investigation and in the negotiations with the other party. Also report circumstances that could lead to a claim later.
