In brief

A scooter is a motor vehicle, so the the insurance requirement in Article 2 WAM. Third-party liability cover is compulsory for as long as the registration is in your name, even when the Agility stays in the shed all winter. If you want to stop that obligation temporarily, you suspend the registration with the RDW. You may then not ride. For damage to the scooter itself, third-party, fire and theft or comprehensive cover needed.

The difference between a light scooter and a moped scooter is decisive. A light moped is restricted to 25 kilometres per hour, a moped to 45. Both require registration and for both there is a compulsory helmet: for moped riders for many years, for light moped riders since 1 January 2023. From the age of sixteen you ride with an category AM driving licence. The 125cc versions no longer fall within the moped category and call for a motorcycle licence.

On a popular city scooter such as the Agility, theft weighs heavily on the premium. Insurers therefore tie theft cover to a security requirement: a lock with ART quality mark in the prescribed category, sometimes supplemented by a tracker or compulsory storage. If that requirement is in your policy and has not been met, theft is simply not covered, however careful you were otherwise.

What makes the difference on this scooter

Four points that go wrong more often on a 50cc city scooter than on a car.

Choosing a light scooter or a moped scooter

The Agility comes in both versions and that difference feeds through into the premium, the licence and the traffic rules. A light moped may generally use the cycle path, a moped usually belongs on the carriageway within built-up areas. A growing number of local authorities are also introducing their own rules for light moped riders. Have the policy record exactly what is on the registration document. A version registered incorrectly leads to argument about the premium and the cover after a loss.

Security determines whether theft is paid

Scooters are stolen more often than cars, and insurers translate that into firm requirements. Usually an an ART-approved lock in a prescribed category is compulsory, secured to a fixed object. Keep the invoice for the lock and both keys: you must be able to produce them at claim stage. If a key is missing or the lock was not used, the claim is refused, even where there was clearly a theft.

What is not covered

The following, among others, are outside the cover: tuning up the engine or a modified construction, even where the modification was made by a previous owner; driving without the required licence category or under the influence; theft without the prescribed ART lock; and damage during hire or delivery work that has not been declared. Wear, punctures and mechanical defects without a collision also fall outside it, as does damage through intent or recklessness (Article 7:952 of the Dutch Civil Code).

Reporting use and modifications

On taking out the policy, the duty of disclosure applies under Article 7:928 of the Dutch Civil Code. If you are going to deliver meals or parcels with the Agility, hire it out through a platform or have a second, younger rider using it on a structural basis, report that. If you do not, the insurer may reduce or refuse payment (Article 7:930 of the Dutch Civil Code). You report a claim as soon as reasonably possible (Article 7:941 of the Dutch Civil Code).

Do I have to insure my Agility even if I do not ride it?

Yes. Article 2 of the Dutch Motor Insurance Liability Act (WAM) ties the insurance obligation to the registration, not to the use. For as long as the registration is in your name, there must be at least third-party liability cover, even if the scooter stands indoors for six months. If you want to save premium over the winter, you suspend the registration with the RDW. While the suspension runs, you may not use the public road.

Is a helmet compulsory on a low-speed scooter?

Yes. Since 1 January 2023 a helmet requirement has applied to light moped riders too. For moped riders it had applied for much longer. If you ride without a helmet, you risk more than a fine: after an injury the insurer or the other party may leave part of the loss at your expense because of contributory negligence. Choose a helmet that meets the statutory approval requirements.

What happens if my scooter has been tuned?

Cover for damage connected with it then falls away and the insurer may cancel the policy. A modified variator, exhaust or ignition makes the scooter a different vehicle from the one insured. If you buy a second-hand Agility, have it checked that nothing has been modified: the fact that a previous owner did it is no defence as far as the insurer is concerned.

Am I allowed to deliver with my scooter?

Only after reporting it and having it accepted. Delivery means far more kilometres in busy city traffic and that is a different risk from commuting. Insurers charge a separate premium for it or decline it. If you make delivery journeys without reporting them, the insurer may refuse payment after a loss because of a concealed increase in risk. The same applies to hiring out through a sharing platform.

Are a top box and helmet included in the cover?

Not as a matter of course. Accessories not fitted at the factory, such as a top box, windscreen or gloves, come under the cover only if they have been notified and a limit has been included for them. For a helmet and clothing, some policies offer separate equipment cover. Ask about it and keep purchase receipts, because without proof of value a claim is difficult.
