In brief

Anyone who has just started driving has no claims record. Insurers fill that gap with age, how long you have held a licence and the vehicle details. That explains why a new driver starts on the lowest steps of the no-claims scale and why the first year is the most expensive. Something can be done about that, but only with choices made in advance: the type of cover, the excess and the registration together determine most of the difference.

The biggest pitfall is not the premium but the registration. A car registered to a parent that is driven by the son or daughter is an incorrect declaration of the regular driver. Insurers ask about that expressly. If it turns out after a claim that the declaration was wrong, the payment can be reduced or refused under Articles 7:928 and 7:930 of the Dutch Civil Code. The fact that the car is someone else's on paper does not help then.

Only the third-party liability cover under Article 2 of the Dutch Motor Insurance Liability Act (WAM)remains compulsory. A deliberate build-up — starting with a car of limited value and third-party liability or third-party liability plus third-party, fire and theft, building up no-claims years and only then extending: works better in practice than going straight to comprehensive on an expensive car. Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Who is the regular driver?

Insurers ask not only about the registered keeper but about whoever drives the vehicle most often. If the car is registered to a parent while the child drives it every day, the declaration is wrong. If that comes to light after a claim, the insurer can reduce or reject the payment under Article 7:930 of the Dutch Civil Code. Declare the actual situation. The premium is then higher, but the cover is real.

You only build up no-claims years on your own policy

Years without a claim are recorded in the policyholder's name, not against the registration. If you drive on your parents' policy, you build up nothing yourself and still start at the bottom later. Your own policy, even on a cheap car, keeps the counter running. Some insurers allocate part of a family member's years on a first policy of your own; ask about that in advance.

Alcohol and drugs set the cover aside

A lower statutory alcohol limit applies to new drivers than to experienced drivers. If it is exceeded, own-damage cover lapses. The injured party is still compensated, because Article 2 of the Dutch Motor Insurance Liability Act (WAM) requires it, but the insurer then recovers the amount paid from the driver. The same applies to driving without a valid licence, during a driving ban or after using drugs.

A higher excess is often a clause, not a choice

Many insurers include an increased excess in the policy as standard for drivers under a certain age. That is separate from the excess you choose yourself and applies per claim. So work out from what amount claiming is still worthwhile: paying a small loss yourself keeps the no-claims years you have just built up intact. Read the clause before you sign. It varies widely per company.

What does your premium depend on?

  • Age and length of time holding a licence. Both count separately. Someone who obtains a licence later in life is not automatically rated as a young driver.
  • Number of no-claims years. Determines your step on the no-claims scale. Without a history of your own you start at the bottom.
  • Regular driver. Who uses the car most counts for more than the registration. A young driver increases the premium on a parent's policy too.
  • Value and power of the car. A car of limited value and moderate power is considerably cheaper to insure for a new driver.
  • Place of residence and storage location. The postcode counts for the risk of break-in and collision; keeping the car on your own property is assessed more favourably.
  • Annual mileage and the excess chosen. A realistic mileage and a deliberately chosen excess bring the premium down without materially affecting the cover.

May the car be registered in my parents' name?

That is allowed, as long as the insurer knows who drives the car most often. That question appears on virtually every application form. If you are declared as the regular driver, the cover is in order and the premium is higher. If you are concealed, the insurer can reduce or refuse payment as soon as the true position emerges after a claim.

Can I take over no-claims years from my parents?

Sometimes. A number of insurers allow part of the years built up by a family member living at the same address to be transferred on a first policy of your own, usually subject to conditions about living at the same address and ending the old policy. It is not a right and the arrangement differs per company. Ask in advance; transferring afterwards rarely succeeds.

Is third-party liability enough for a new driver?

In law it is: third-party liability is the only compulsory cover. In practice it depends on the value of the car. On an older car of limited value, third-party liability or third-party liability with third-party, fire and theft is often defensible, because a total loss can be borne. On a car you cannot simply replace, own-damage cover counts for more than the saving in premium.

What happens after a claim in the first year?

You fall back on the no-claims scale and pay more the following year. On a small claim, paying yourself can work out cheaper than the fall back plus the excess. Ask the insurer for a calculation of the effect before you have the report finally processed; within a short period after payment you can still repay the claim at many companies.
