In brief

If the quad has a registration, it is a motor vehicle and the insurance obligation of Article 2 of the Dutch Motor Insurance Liability Act (WAM) applies for as long as the registration is in your name. That third-party liability cover runs on the public road. Where it goes wrong is the assumption that the cover applies everywhere: riding away from the public road is in fact excluded under many policies.

In practice a quad is used in three ways: as a road-going vehicle, as a working vehicle on a yard or plot, and as a recreational vehicle off-road. Each of those three carries a different risk. Off-road, rolling over is the most common cause of loss, and that means damage to the vehicle itself plus, often, injury to the rider or the passenger.

If you ride without a registration exclusively on your own land, the absence of the WAM obligation does not automatically remove your liability: for injury to someone else, Article 6:162 of the Dutch Civil Code continues to apply. What does your premium depend on?

  • Vehicle category on the registration certificate. The registration determines which rate and which conditions the quad comes under.
  • Engine capacity and power. Heavier machines lead to higher claims costs in a collision and a roll-over.
  • Where you ride. The public road only, or off-road as well; off-road use calls for an extension.
  • Age and no-claims years. The rider's age and no-claims years built up count towards the rate.
  • Storage. A locked shed or barn as against keeping it outside; quads are easily driven away.
  • Additional modules. Riders' cover, personal accident cover or accessories cover come on top of the basic cover.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Off-road riding is a separate agreement

A standard quad policy is written for the public road. Riding on your own or rented land, in the dunes, on a motocross track or on a wooded plot falls outside the cover under many sets of conditions. If you do that regularly, ask expressly for cover that includes off-road use and have the locations recorded. Without that extension, you bear both the damage to the vehicle and the liability for injury there entirely yourself.

Rolling over produces two losses at once

A quad has a high centre of gravity and a narrow track. On a sloping bank, at a ditch or in a bend taken with too much throttle it rolls over, and then there is damage to the vehicle and injury to the rider. Own-damage cover deals with the first. The second runs through personal accident or riders' cover that you have to choose separately. Third-party liability cover does not pay the rider, who is after all the person who caused the loss.

Use for work on the yard changes the policy

If you use the quad for spraying, towing or checking livestock, that is not private use. Report the use for work and also report any attachments and trailers: a sprayer, a spreader or a cart does not count on an ordinary quad policy. If staff work with it, your employers' liability under Article 7:658 of the Dutch Civil Code comes into play and an ordinary private policy is not enough.

Where the cover stops in any event

Three situations are absolute exclusions. Riding without the licence that goes with the vehicle category on your registration document causes all cover to fall away, including own-damage cover. Taking part in races, trials or speed events is never covered, not even on a closed circuit. And damage through wear or a mechanical defect, for instance a burnt-out clutch after heavy off-road use, falls outside every version.

Is riding on my own land included in the cover?

Often not. Most quad policies are written for use on the public road and exclude off-road riding. If you ride on your own plot, a motocross track or rented land, ask for an extension and have the locations recorded. Without that agreement you bear both the damage to the quad and the liability for injury to others yourself.

Is my passenger insured?

A passenger injured through your doing is an injured third party and comes under third-party liability cover. However, you may only carry a passenger if the quad is equipped for one according to the registration document. If it is not, the insurer may recover the payment to the victim from you. For your own injury, separate personal accident cover is needed.

Do I have to stay insured while the quad is in the shed?

For as long as the registration is in your name, yes, under Article 2 of the Dutch Motor Insurance Liability Act (WAM). If you only ride in season, you can suspend the registration; the third-party liability obligation then falls away, but you may no longer use the public road either. Theft or fire cover does not automatically continue during a suspension, so ask what does remain in force.

Is a trailer or a mounted sprayer included in the cover?

No, not without being declared. A quad policy covers the vehicle as it was notified. A trailer, spreader, sprayer or winch belongs on the policy separately with its value stated. If damage is caused with it while it has not been declared, argument about cover arises. Also let us know if you use the quad for work on a structural basis.
