In brief

A remedial teacher works with a support plan: goals, approach, evaluation points. The complaint parents or a school make afterwards is almost never about the lessons themselves, but about time. A child was supported for a year while something else was going on, and that was only discovered a school year later. The loss is then assessment elsewhere, tuition and sometimes a missed transition.

That complaint concerns pure financial loss: nobody is injured and nothing is damaged. Liability insurance for businesses covers only property damage and injury and leaves this category out of account. So for the support work itself you need professional indemnity cover. The AVB remains important as well, for a child who falls in your practice room.

What does your premium depend on?

  • Insured business activity. Remedial teaching only, or coaching, training and assessment as well. The broader it is, the higher the premium.
  • Annual turnover. Turnover is the usual rating basis for a one-person practice or a small agency.
  • Working at your own premises or at a school. Your own practice room brings an injury risk that at a school lies with the school.
  • Client group and age of the pupils. Support around exams and transition points involves more at stake if there is a delay.
  • Sum insured and excess. The limit per claim and per insurance year and the excess per notification.
  • Number of staff or colleagues engaged. If you work with others, liability for their conduct under Article 6:170 DCC comes into play.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Diagnosis lies outside your capacity

Establishing dyslexia, dyscalculia or a developmental disorder is reserved for an educational psychologist or a psychologist. If you nevertheless make statements that are read as a diagnosis, or issue a certificate, you act outside the insured capacity on your policy schedule. A claim arising from that is rejected, however carefully you worked otherwise. Keep your reporting descriptive.

Referral is an obligation in its own right

If results fail to come while you follow the support plan, there has to be a point at which you flag that further assessment is needed. If you carry on supporting the child, the delay is for your account. Record at each evaluation point what you saw, what you discussed with parents and school and where you referred the child. That file is your main defence when a claim comes.

Your contract determines who holds you liable

If you are engaged by the school, the school is the party instructing you and complaints from parents in principle run through that school. If you work directly for parents, the family is your counterparty. Report both situations when declaring your activities. If you are employed by a school, Article 6:170 of the Dutch Civil Code applies and liability rests primarily with the employer.

Pupil data call for a separate arrangement

You process data about learning performance and sometimes about a child's health. If that data leaks, it is neither property damage nor injury and it is not a classic professional error either. A fine from the regulator is also excluded on every policy as sanction. For the remediation costs and the duty to report after a data breach, separate cyber cover is needed.

May I issue a dyslexia certificate?

No. Establishing dyslexia and issuing a certificate is reserved for a qualified behavioural scientist. If you do it anyway, you act outside the capacity stated on your policy and a claim arising from it is not covered. You can flag concerns, describe what you observe and refer the child on.

Why is an AVB not enough here?

Liability insurance for businesses covers damage to people and property. The complaint against a remedial teacher concerns lost time and the cost of alternative assessment, with no injury or damage. That is pure financial loss and falls outside the cover on an AVB. For that you take out professional indemnity insurance, with its own limit per claim.

Am I covered if a child falls at my home?

If you work from a practice room at home, that is an injury claim and it belongs with liability insurance for businesses, not with professional indemnity. Declare that you receive children at your work address, because a policy that assumes office work only sometimes excludes visits by third parties.

What if I am employed by a school?

Then your employer is in principle liable under Article 6:170 DCC for mistakes you make in the performance of your job, and a claim runs through the school's policy. If you also take on your own assignments for parents, that part is not covered and you need your own cover for that practice.
