In brief

An educational consultant rarely causes damage to property or people. What you cause is pure financial loss: a school buys a teaching method that does not fit, an implementation programme has to be done again, a grant or funding claim turns out to have been made wrongly. That type of loss falls outside public and employers' liability insurance and belongs on a professional indemnity insurance.

The second feature is the time between advice and consequence. Education works in school years. Advice on assessment policy, progression or learning pathways can only be judged at an inspection visit or an audit, sometimes three years later. On a claims-made policy what counts is the moment the school holds you liable, not the moment of your advice. Without retroactive cover when you switch and run-off cover when you stop, a gap appears there.

Outside the cover: administrative sanctions and fines imposed on the school itself, recovery of funding as such, a dispute about your own fee or redoing your own assignment, and damage you caused knowingly and deliberately (Article 7:952 of the Dutch Civil Code).

What does your premium depend on?

  • Type of assignments. Facilitating a process weighs less than advice on which an investment or funding decision depends.
  • Size of the school boards. A single-school board or a board with dozens of schools. The size determines how far a mistake reaches.
  • Annual turnover from advisory work. Turnover from advisory work is the rating basis, not turnover from training or teaching hours.
  • Sum insured chosen. Per claim and per year; boards increasingly include this in their purchasing conditions.
  • Retroactive and run-off periods. The number of years of advice you insure backwards or forwards weighs visibly in the premium.
  • Excess and claims history. Previous claims and the excess chosen per claim adjust the premium.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Define the assignment against what you do not deliver

Most complaints against educational consultants concern scope: the school believed it had also bought an opinion on funding, staffing or employment status. Set out in the confirmation of instructions which questions you do and do not answer, and which data supplied to you you are relying on. In a claim under Article 6:162 DCC that definition is the first thing your insurer asks for, and often the only solid defence there is.

Advice that works through for years calls for run-off cover

A curriculum revision or a new support structure is rolled out over several school years. If an inspection visit shows that the design was not sustainable, the claim comes long after your last invoice. If you close your practice or move to another insurer, arrange run-off cover for the years in which you advised. Without that arrangement there is no current policy at the moment of the claim.

Pupil data you process along the way

For an analysis of results or progression you receive files at pupil level. That data remains the school's. You are the processor. A file circulating through a private mailbox or an unsecured shared folder produces a data breach for which the school will hold you liable. A liability policy does not cover an administrative fine or the school's remediation costs. Work only in the school board's own environment and record the processing arrangements.

What you say in a participation process

Educational consultants are engaged in mergers, the closure of a site or the reorganisation of a team. Statements in that process are read by staff and parents as a judgement about individuals. An allegation of careless or incorrect characterisation is then directed at you personally. Frame findings at system level, have factual inaccuracies corrected in advance and keep the draft versions together with the responses.

Do I need an AVB as well as professional indemnity insurance?

Only if you also work physically on site. If you give training, bring equipment or receive people in your own premises, injury or property damage can arise and that falls solely under public and employers' liability insurance. If you advise only on paper and digitally, professional indemnity cover is the part that really matters.

A school claims the cost of a teaching method it bought. Is that covered?

Only the part that is a loss and not the part that concerns your own work. The cost of a method bought on your incorrect advice and unusable can be treated as financial loss. Your own fee and redoing your assignment do not fall under it. You carry those costs yourself.

What if I work through a secondment agency or a consultancy?

Then the client can approach in two ways: the agency under Article 6:170 DCC for mistakes by those working for it, and you personally. Check whether the agency's policy names you as an insured. If it does not, keep your own cover in place alongside the assignment.

Do I have to report a complaint that is not yet a claim?

Yes. Article 7:941 DCC requires notification as soon as you know of a circumstance that could lead to a claim. In education that almost always starts with a conversation or a letter from the board expressing doubts about your advice. Notify that circumstance within the current policy period, even if no amount has been mentioned yet.
