In brief

An expat goes abroad temporarily, usually with a continuing contract or with a local appointment and an agreed return. The starting point is social security. With an A1 certificate the employee remains insured under the Dutch system within the EU, the EEA, Switzerland and treaty countries. Without that certificate, or on a posting to a country with which there is no treaty, he falls outside it and two gaps open up at once: medical care and disability.

The employer's obligations also cross the border. The duty of care under Article 7:658 of the Dutch Civil Code applies at a foreign workplace too, and Article 7:611 DCC on good employership extends to taking out proper insurance for risks connected with the posting. An employer who fails to do so can be liable for the loss the employee is consequently left with.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

The A1 certificate sets the starting point

Within the EU, the EEA, Switzerland and treaty countries, a posted employee with an A1 certificate remains socially insured in the Netherlands. Cover under the Health Insurance Act then continues, but reimburses foreign care up to the Dutch tariff at most. Outside those countries the obligation to insure ends as soon as the centre of life shifts. Expat cover tops up the difference in the first case and takes over medical care entirely in the second.

Who is the policyholder, and what happens when employment ends

If the policy is in the employer's name, cover ends when employment or the posting is terminated or when the employee is recalled, while the employee may still be abroad at that moment. Record in writing who cancels, as at what date, and whether individual continuation is possible. In practice this is the most common cause of an uninsured period during a posting.

Accompanying family and those staying behind

A partner and children who move with you must be expressly insured. Their own basic health insurance ends on deregistration just as firmly as the employee's does. A partner who continues to live in the Netherlands does not fall under the expat cover and keeps their own Dutch policies. The same applies to school-age children who stay behind here; check that no in-between situation arises in which someone is covered nowhere.

What expat cover does not resolve

Outside the picture are disability and pension accrual during the posting, locally compulsory social insurance contributions that you still pay on the spot, and events caused by war, insurrection or political evacuation in countries subject to negative travel advice. The employer's liability towards third parties on the spot also falls outside it: that runs via Articles 6:170 and 6:171 of the Dutch Civil Code and belongs in public and employers' liability insurance (AVB).

Defence & legal costs

What does your premium depend on?

  • Country of posting. The local level of medical costs is decisive. A few countries have a separate rating group.
  • Length of the posting. A secondment of a few months is set up differently from a placement of several years.
  • Number of family members covered. Every accompanying partner and every child is assessed and counted separately.
  • Age profile of the group. With group postings, the average age of the participants feeds through into the rate.
  • Level of cover and excess. A package with dentistry, pregnancy and preventive care is higher than cover for medically necessary care alone.
  • Evacuation and repatriation. Including medical evacuation and repatriation weighs more heavily the more remote the destination is.

Insurers weigh these details differently. That is where your saving is.

Does my Dutch health insurance continue during the posting?

Only if you remain socially insured in the Netherlands, which is the case within the EU and treaty countries with an A1 certificate. Basic health insurance then reimburses foreign care up to the Dutch tariff, which in many countries is far below the actual bill. Outside those countries the obligation to insure ends and you need full international cover.

Does my employer have to arrange insurance for me?

The duty of care under Article 7:658 of the Dutch Civil Code applies at a foreign workplace too, and Article 7:611 DCC requires good employership, which includes taking out proper insurance for risks connected with the posting. If an employer fails to do so, they can be liable for the loss you are consequently left to bear.

Is my partner automatically covered as well?

No. Accompanying family members must be named on the policy. Their Dutch basic health insurance ends on deregistration with the local authority, so without being named on the expat policy they are uninsured from the date of the move. If your partner continues to live in the Netherlands, they keep their own Dutch policies and fall outside this cover.

What happens if the posting ends early?

A policy in the employer's name then usually ends as at the date on which the employment or the placement ends, while you may still be there. Agree in advance how long cover continues after a recall and whether you can continue it individually. Otherwise short bridging cover until your return is necessary.
