In brief

Two obligations apply from the moment you settle here. Anyone living in the Netherlands or paying wage tax here is in principle required to take out health insurance and must do so within a few months of arrival. If you drive a car or motorcycle, the the insurance requirement in Article 2 WAMapplies: a motor vehicle with a Dutch registration must have at least third-party liability cover, even when it is not being used.

There is also cover that is not compulsory but is regarded as normal in the Netherlands. A personal liability insurance meets losses that you or your family members cause to others. The basis for that is the wrongful act provision of Article 6:162 of the Dutch Civil Code. Contents insurance for your belongings in a rented home and legal expenses insurance for a dispute with an employer or landlord are also usual.

Do not assume that a policy from your home country moves with you. Many foreign policies have a limited geographical scope, a fixed period of stay, or lapse as soon as your main residence changes. Cover provided by your employer for a posting also often covers only work and travel, not your private life here.

Points to note on arrival and departure

Two points where things go wrong for expats in practice.

Your details determine whether the policy is valid

When taking out insurance you must give the information requested correctly and in full. That is the duty of disclosure of Article 7:928 of the Dutch Civil Code. A temporary address, a foreign driving licence, a second home in your home country or a claims history built up in another country are all relevant. If the statement is incorrect, the insurer may reduce or refuse the payout (Article 7:930 of the Dutch Civil Code).

What a Dutch policy does not cover either

Do not expect cover for intent and recklessness (Article 7:952 of the Dutch Civil Code), for damage or illness that already existed before the policy started, or for business use of a private car or private belongings without that having been disclosed. Nor do financial loss from an employment dispute, fines and losses in countries outside the agreed geographical scope fall within the policy. If you leave again, cancel in good time: a policy running on without a residential address here does not provide valid cover.

What does your premium depend on?

  • Claims history: years abroad do not always count
  • Driving licence and driving experience: country of issue and number of years
  • Area of cover chosen. Europe or worldwide

Do I have to take out Dutch health insurance?

As a rule, yes. Anyone living in the Netherlands or paying wage tax here is required to insure and must take out health insurance within the statutory period after arrival; cover applies retrospectively from the moment the obligation arose. There are exceptions, for example for a short posting with an A1 certificate. Have your situation assessed before you assume you are exempt.

Can I keep my foreign motor insurance?

Not once the car has a Dutch registration. Article 2 of the WAM requires the registered keeper to hold at least third-party liability cover with an insurer permitted to operate here. If the foreign registration stays in place, that country's rules apply plus a valid green card, but on permanent settlement that is usually not a sustainable route. Check this before you start driving.

Do my no-claims years from abroad count?

Sometimes. Dutch insurers can take over foreign no-claims years on the basis of an original statement from your previous insurer, but they are not obliged to and apply different maximums. Request that statement before you leave; obtaining it afterwards often takes a long time. Without it you start at the lowest step and pay more premium.

Is liability insurance compulsory here?

No, not for private individuals. You are, however, liable yourself under Article 6:162 of the Dutch Civil Code for loss you unlawfully cause to another person, and that loss can run high. Landlords and schools therefore often assume that you have such cover. The insurance usually applies to all family members living at the same address.
