In brief

In assembly work three kinds of loss run together. Damage to people and to third-party property belongs with the public and employers' liability insurance (AVB), usually based on tort (Article 6:162 of the Dutch Civil Code). Damage to the works you are making belongs with a Construction all risks (CAR) or erection insurance. And loss that arises purely from a mistake in advice, without anything being broken, is pure financial loss and falls under professional indemnity.

That distinction is no formality. If you install a pipework system and damage the client's floor in the process, that is a third party's property damage. If you damage the pipe you are installing, that is damage to the works and the AVB does not pay. If you then put your own defective installation right, that is free rectification and that is not insured anywhere — it is a business risk.

On top of that, installation engineers have to deal with fire risk. Welding, soldering and flame cutting on site are the most common cause of large losses in this sector. Where things go wrong in practice

Four points that make the difference in assembly work between cover and your own account.

The item worked on is not insured

An AVB excludes damage to the item you are working on and to the work you have supplied. If you replace a boiler and that boiler is damaged while you fit it, that is your own loss. If the same mistake floods the ceiling of the floor below, that is a third party's property damage. The care, custody and control clause softens this in part, but it almost never applies to the part you are actually working on and it also has a lower limit of its own.

Fire-hazardous work has strict conditions

Welding, soldering, flame cutting and working with naked flames are almost always tied to clauses: clearing flammable material from the area, screening off, extinguishers within reach, checks afterwards and often a permit to workrecorded in writing. If those are not met, the fire damage is not covered, however small the omission may seem. Complete the form for each job and have it signed. If there is a loss, that is the only evidence.

What is not included

The following, among others, are outside the cover: the cost of repairing or replacing your own work, pure financial loss such as loss of production without anything being broken, fines and contractual penalty clauses for late completion, loss caused by a deliberate breach of safety rules, and damage to property you transport. guarantee and maintenance obligations that you have entered into by contract also go further than an insurance policy covers. Intent and recklessness fall under Article 7:952 of the Dutch Civil Code.

Subcontracting, hired-in staff and disclosure

If you engage subcontractors, you can be liable under Article 6:171 of the Dutch Civil Code for their mistakes towards the client. Check that their liability cover is in force and that your own policy includes subcontracting. Give an accurate picture of your activities, turnover and area of operation on your application. That falls under Article 7:928 of the Dutch Civil Code and an incorrect statement can cost you the payment through Article 7:930 of the Dutch Civil Code. Report a claim as soon as reasonably possible (Article 7:941 of the Dutch Civil Code) and never accept liability yourself.

What is the difference between the AVB and a CAR or erection policy?

The AVB covers loss you cause to people or to other people's property. CAR or erection insurance covers the works themselves during the work, including the materials on site and often the client's existing property. On an assembly job you need both; they dovetail rather than replace each other.

What does the care, custody and control clause mean?

Care, custody and control is about someone else's property that you have in your care, for example a machine you are repairing or a building you are working in. That damage is excluded as standard on an AVB. With a care, custody and control clause it is covered on a limited basis, usually with a lower limit and an excess. The item you are actually working on almost always remains excluded.

Is a mistake in the design covered?

Not on the AVB, as long as no property damage or injury results from it. A calculation error that leads to an installation with too little capacity produces pure financial loss; professional indemnity insurance is needed for that. If you do both design and installation, both covers are relevant.

Do I have to use a work permit for fire-hazardous work?

If the policy requires it: yes, and then for each job. The form records which measures were taken, who is supervising and how long checks are carried out afterwards. Insurers test this strictly when there is fire damage. Without a completed form it is hard to show that the clause was met, even if you did take the measures.

Am I liable for my subcontractor's mistakes?

Often yes, towards the client. Article 6:171 of the Dutch Civil Code makes the principal of a non-subordinate liable for loss arising in the performance of that party's work, where that work forms part of your business. Set out in the contract what cover the subcontractor maintains and ask for proof of insurance each year.
