In brief

Finass Advies acts as an intermediary and compares objectively what several insurers offer; Chubb is one of them. We first establish which cover you need and then look for the company that meets it best. An application ends up with this insurer when a standard policy is not enough: a home with exceptional contents, an art collection, or a business with premises or customers abroad.

With high values, the conversation turns on the determination of value. A valuation by an expert leads to an agreed valuation: the parties fix the value in advance, so that no dispute arises about it when you claim. That is the counterpart of the indemnity principle in Article 7:960 of the Dutch Civil Code, which provides that a payout may not place you in a clearly better position. Without a valuation the market value at the time of the loss applies, and with jewellery, art and collections that rarely works out well. See also valuables insurance.

The second area is the commercial side: liability, cyber, directors' and officers' liability and international programmes. What a policy actually covers is set out in the policy conditions, which you receive before signing. With English-language conditions and international structures, how they translate into Dutch law is a point to watch in its own right.

What to look out for

Four points that lead to disputes more often than the premium with this type of policy.

Agreed valuation and how long it remains valid

A valuation report has a limited period of validity, often a few years. Once that period expires, the binding effect lapses and you fall back on the value at the time of the loss. Put the expiry date in your diary and have a fresh valuation carried out, certainly for collections whose market value moves.

Prevention clauses are not a formality

With high values, the policy schedule almost always carries a clause about security : a certified alarm with remote signalling, a safe of a particular grade, or requirements for locks and fittings. If that requirement is not met at the time of the burglary, the insurer may limit or refuse the payout. A clause on the policy schedule takes precedence over the general conditions.

Area of cover and jurisdiction

Worldwide cover is not the same as worldwide jurisdiction. Many policies exclude claims brought before a court in the United States or Canada, or cover them only after an express extension. If you work there, or supply there, that must be on the table when you apply.

What is never covered

Excluded are intent and recklessness (Article 7:952 of the Dutch Civil Code), war risks and nuclear reactions, and wear and tear, inherent defect and deferred maintenance. Also administrative fines and penalty payments fall outside any liability cover: that is a penalty, not compensation for loss. Loss of value because a restored item is worth less than before is by no means always compensated.

What does your premium depend on?

  • Insured value — valued or declared, per item and in total
  • Nature of the items or activities — art, jewellery or a particular industry
  • Security and prevention — alarm, safe, sprinkler or inspections
  • Area of cover — the Netherlands, Europe, worldwide, or including the US and Canada
  • Excess — per event and sometimes differing per section
  • Claims history — the number and nature of earlier claims

Why would I choose a policy from this insurer?

Only if the conditions suit your risk better than those of another company. We compare objectively and the choice follows from your cover requirements, not from the name. With high values, activities abroad or a risk that standard insurers will not accept, that comparison more often comes out this way.

What is the difference between an agreed valuation and a declared value?

With an agreed valuation, a recognised valuer establishes the value and the parties fix it in advance; when you claim, that amount is in principle binding. With a declared value, you name an amount yourself and the loss adjuster only assesses what the item was worth after the loss. You notice that difference above all with unique items for which there is no ready market price.

Do I take out the policy with the insurer or with Finass?

The contract runs between you and the insurer: the insurer issues the policy schedule and pays the claim. Finass advises on the cover, handles the application and represents your interests in changes, renewal and claims handling. Are English-language policy conditions a problem?

Not by definition, but they call for attention. Terms such as occurrence, claims made and aggregate have a fixed meaning that does not always correspond exactly to the Dutch wording.
