In brief

An internship agreement has a learning objective: you are there to learn the trade, not to produce output. If an intern does ordinary work under direction and for payment, a court may find that there is in fact a contract of employment, with all the entitlements to pay that go with it. That is the most common internship dispute.

The other issues are early termination, an unsatisfactory assessment that affects the course, and the supervision the host organisation had promised. Three parties are involved: student, college and business, and the internship agreement rarely sets out who is responsible for what.

Legal expenses insurance has a waiting period after the policy starts and a threshold: a case is not taken on below a certain financial interest. If the case goes to court, you have a free choice of lawyer. A dispute whose cause already existed when you took out the insurance is excluded.

What does your premium depend on?

  • Children living away from home included. Whether a student in digs is still an insured person decides whether an internship dispute falls within the policy at all.
  • Work and income module. Without this module only consumer, traffic and home matters remain, and an internship case is not covered.
  • Threshold amount. With unpaid internships the financial interest is small, so the case may fall below the threshold.
  • Personal contribution per case. Some policies have a fixed amount you pay yourself as soon as an external expert is brought in.
  • Area of cover. An internship abroad falls within the policy only if the area of cover allows it.
  • Waiting period. Work-related disputes are only taken on after the policy has run for a number of months.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Learning or working: the difference decides the entitlement

The name of the contract is not decisive; how it works is. If an intern works full shifts, stands in for a sick member of staff or is judged on output, the balance shifts towards a contract of employment and therefore towards an entitlement to pay. For the business that is a risk, for the student an opportunity. A lawyer assesses tasks, direction and pay together, not in isolation.

Early end to the internship

If the business stops the internship halfway through, that immediately affects progress on the course: a new placement has to be found and the course takes longer. The internship agreement often contains a termination clause, but rarely any arrangement for the loss that follows. Legal expenses cover focuses here on the triangle with the educational institution, which has its own role in assessment and in finding a replacement placement.

Injury during the internship

The duty of care of Article 7:658 of the Dutch Civil Code applies through subsection 4 to people carrying out work without a contract of employment as well, such as interns. So the business has to have instruction, supervision and protective equipment in order, even for someone still learning the work. If something happens, that is a recovery case against the business and not an employment conflict; it falls under a different module from the dispute about the placement.

What the policy does not take on

Disputes with the educational institution about a mark, a binding study advice or tuition fees are not covered by most insurers. Cases with an interest below the threshold amount are also left aside, as are conflicts that were already running when the policy was taken out. And the intern's own liability for damage at the business belongs with the liability insurance.

Is an intern entitled to pay?

Not automatically. In a genuine learning placement with an internship allowance there is no contract of employment and therefore no entitlement to the minimum wage. If in practice the intern does ordinary productive work under direction, a court may find that in substance a contract of employment does exist. What actually happens is decisive, not what is written at the top of the contract.

Is my child at college covered by our family policy?

With many insurers, student children living away from home remain insured as long as they are studying and do not run their own household. The wording differs per policy and sometimes an age limit applies. Because an internship dispute is only handled if the intern is an insured person, we check that clause before anything happens rather than afterwards.

The host business is stopping the internship. What can I do?

First ask for the reason in writing and involve the college's placement supervisor straight away: they have their own interest in finding a replacement placement. If the business terminates without grounds and contrary to the internship agreement, a lawyer can claim performance or compensation. Speed counts for more here than in an ordinary employment conflict, because the delay to the course keeps running.

My child broke something during the internship. Who pays?

That is a liability question, not a legal expenses case. Damage caused by someone while working for another party is often attributed to the organisation they were working for. If the intern is still held responsible, personal liability insurance (AVP) comes into play, provided it is not regarded as a business activity. Report the damage to both insurers.
