In brief

As soon as a customer hands over the keys, you have their car in your care. And property in your care is exactly what an ordinary public and employers' liability policy excludes, or limits to a token amount. If a car falls off the ramp, the workshop burns out or your mechanic runs into the back of someone on a test drive, the AVB offers no solution.

This policy fills that gap. It insures damage to the customer's vehicle throughout the period it is with you: during repair and servicing, while being collected and delivered, in winter storage, on a test or delivery drive and for as long as it stands on your premises waiting for parts.

For your own stock you need trading stock insurance and for third-party liability during journeys you need trade plate insurance. These three policies each cover a different moment in the same business and do not overlap.

What does your premium depend on?

  • Number of vehicles in your care. The average and the maximum standing on the premises or in the workshop at any one time.
  • Nature of the work. Accident repair and paint work carry a different fire and damage risk from servicing or tyre changes.
  • Test, collection and delivery drives. How often and how far customer vehicles are driven, and by whom.
  • Site security and key management. Lockable premises, cameras, alarm response and a certified key cabinet.
  • The segment of customer vehicles. A business that mainly works on prestige or nearly new cars insures higher values.
  • Limit and excess per event. The maximum amount per vehicle and per event has the strongest influence on the premium.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

The care, custody and control exclusion is the whole point

Liability insurers exclude damage to property you have in your care, because such damage is predictable and connected with the quality of your work. For a garage, accident repair centre, tyre specialist or valeting business that means the most expensive object on the premises is not yours and is not covered. Customer vehicle insurance puts that right, with its own limit per vehicle and per event that you choose separately.

Workshop, ramp and test drive

The claims that come in on this policy are concrete: a car set wrongly on the lift and tipping over, a tool trolley rolling into a door, paint damage from grinding dust, a fire spreading from a welding point, and a collision on the drive to check whether the noise has gone. Theft from the premises and vandalism at the weekend are also among the usual sections.

What is not covered

The policy does not pay for putting right your own work: if you fit the wrong parts or leave a bolt loose, redoing that repair is your own cost. Also excluded: wear, mechanical defects and faults that were already present, and the customer's consequential loss such as a hire car, loss of income or diminution in value. Theft while the car stood unlocked with the key in it almost always leads to a reduced payment.

Key management and documented handover

Almost every dispute about a customer vehicle turns on two questions: was the vehicle entrusted to your care at the time of the damage, and where was the key. Work with a vehicle intake form on which existing damage is signed off, and with a lockable key cabinet. Without that record you face an argument about damage the customer says was not there before, and that is an argument you will not win after the event.

This is what people ask us most.

Is this not simply part of my public and employers' liability insurance?

No. An AVB excludes property in your care or pays for it up to an amount that is inadequate for a modern car. Some insurers offer limited care, custody and control cover as an extension, but that is intended for occasional situations, not for a business with dozens of vehicles on site every day. Have the care, custody and control clause in your current policy read side by side with this cover.

Who reports the claim: my business or the customer?

You report it, because you are the policyholder and the car was entrusted to your care. Do so as soon as you know, as Article 7:941 of the Dutch Civil Code requires, and inform the customer at the same time. If you let the customer report it to their own comprehensive insurer, that insurer will then recover from you and the customer will lose no-claims years, with a complaint as the predictable result.

Does the cover also apply if a customer's car is parked at an employee's home?

Usually not. The cover is linked to your business location and to journeys for a business purpose. A mechanic who takes a customer's car home in order to start earlier the next morning falls outside the wording. If you want that included, it must be insured explicitly. Set an internal rule that customer vehicles do not leave the premises outside working hours.

What if I believe the damage was already there?

Then the intake form is decisive. If existing damage is noted on arrival and signed off by the customer, with photographs where appropriate, it can be shown afterwards what has been added. Without that record it is your word against the customer's and the insurer will assess the claim critically. A fixed intake procedure is the cheapest preventive measure on this policy.
