In brief

A hobby tractor is a machine that is no longer used for production: a restored classic, a tractor for maintaining your own plot, or a machine that mainly appears at shows and parades. The limited use reduces the premium, but it also makes the risks different from those of a machine that works the land every day.

Two things call for attention. First the value: with a restored tractor, market value does no justice to the work and the parts that have gone into it. A valuation report fixes the value bindingly under Article 7:960 of the Dutch Civil Code, so that after a total loss or theft you do not end up with the trade value of an old tractor.

Second, use at events. Taking part in parades, classic vehicle days and tours falls outside the cover under some policy conditions, and that is precisely what you keep the tractor for. Report it expressly. If the tractor really goes to work, it belongs on the agricultural tractor insurance.

What does your premium depend on?

  • Agreed or declared value. With a restored machine the valuation figure is the basis of calculation, not the market value.
  • Nature of use. Purely hobby use, yard maintenance or still the occasional job makes a difference to the rate.
  • Taking part in events. Parades, shows and tours have to have been taken into account at acceptance.
  • Storage. A locked barn as against an open lean-to differs in fire and theft risk.
  • Year of manufacture and originality. The supply of parts and the repairability of old machines count in the assessment.
  • Cover and excess chosen. Third-party liability for the road only, or supplemented with fire, theft and own-damage cover.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Report participation in events expressly

If you take part in a parade, appear at a classic vehicle day or go on a tour with the club, have that recorded on the policy. Taking part in organised events is excluded under some policy conditions. There are also spectators around such an event; injury to a bystander is a question of liability under Article 6:162 of the Dutch Civil Code in which the organisation and the driver are both quickly looked at.

Have a restored tractor valued

Restoration costs are not included in the market value. A valuation report by a recognised valuer makes the value binding under Article 7:960 of the Dutch Civil Code and prevents argument after a theft or a fire in the barn. Note the period of validity: if the report expires, you fall back on market value without warning. Photograph the tractor once the restoration is complete and keep the invoices for original parts.

On the public road the traffic rules simply apply

A hobby tractor too, if it goes onto the public road, has to be registered and insured under Article 2 of the Dutch Motor Insurance Liability Act (WAM), and the driver needs the corresponding licence. With a machine that only drives to a show twice a year, that is easily forgotten. If the tractor stays exclusively on your own yard, the WAM obligation falls away, but not your liability towards visitors and helpers.

What is not reimbursed

Three things are never included. Wear, rust and mechanical defects are not damage but age. A seized engine or leaking hydraulics falls outside the cover. Damage during tractor pulling, skills competitions or other tests of strength is excluded, even where it is a demonstration. And damage that arises during restoration in a workshop falls under the liability of the business working there.

Is taking part in a classic vehicle day covered?

Not automatically. A number of policies exclude taking part in organised events, while that is exactly the use for which a hobby tractor is kept. Report it on the application and have it recorded that parades, shows and tours are insured. Tests of strength such as tractor pulling remain excluded even then. For those the organiser usually arranges separate event cover.

Why is a valuation report sensible?

Because the market value of an old tractor bears no relation to what you have put into it. With a valuation report from a recognised valuer the value is fixed under Article 7:960 of the Dutch Civil Code and you do not have to negotiate after a fire, theft or total loss. Do note the period of validity of the report: once it has expired, the insurer will settle on market value after all.

Do I need insurance if the tractor only stays on my yard?

The insurance obligation under Article 2 WAM applies to use on the public road. If the machine stays on your own land, that obligation falls away, but your liability does not: if a visitor or helper is injured, you are held liable under Article 6:162 of the Dutch Civil Code. There is also no cover for fire or theft from the barn without additional cover.

Are my tools or attachments insured?

Only what is on the policy. A front loader, mower bar or trailer that you couple up now and then should be declared separately with its value. Without a declaration there is no insurable interest and no settlement follows for that part after a fire or theft. The same applies to loose tools kept in or on the tractor.
