In brief

There is no governing body and no fixed definition. On an application you therefore describe the act, not the name: swinging away on a rope from a platform, bridge or crane, with a short free fall at the start. Insurers place that alongside bungee jumping and canyon swings.

On many travel and personal accident policies that category is excluded by name: jumping or dropping from a height. Where acceptance is possible, it applies only with a certified operator. A home-made rope swing on a tree is insured nowhere.

Where things go wrong in practice

Two points that keep coming back with activities of this kind.

The exclusion looks at the act, not the name

Policies generally name mountain sports, air sports, deep diving and speed competitions and also jumping from a height. Swingbo falls under that last item, even where the word does not appear. A new name for a familiar act does not change the assessment.

Abseiling and your insurance

The waiver you sign limits your recovery

Operators almost always have participants sign a statement. Such an exclusion clause does not rule out everything: with a defective structure the operator may be liable as the owner of the structure (Article 6:174 of the Dutch Civil Code) or under Article 6:162 of the Dutch Civil Code. Keep the statement you signed.

What does your premium depend on?

  • Age and health — counts on personal accident cover

Frequently asked questions

The questions we are asked most often about this.

Why does swingbo not appear in my policy conditions?

Because it is not a recognised name for a sport. Insurers work with categories, not with the brand names of attractions. Your activity is placed under jumping or dropping from a height, the same item as bungee jumping.

Is a one-off attempt covered?

Not automatically. Exclusions apply to one-off participation as well. Some insurers accept a single jump with a certified operator if it is reported in advance; have that recorded in writing before you leave.

What if the structure fails?

Then the operator may be liable as the owner of the structure or for acting without due care. Report the accident to your insurer, record the situation with photographs and keep the participation conditions and the waiver.

Does my liability insurance cover damage to the installation?

Usually on a limited basis. Damage to items in your custody falls under the care, custody and control exclusion and is often excluded. Injury you cause to someone else is generally included, unless the activity itself is excluded.
