In brief

The term skiwal does not appear in policy conditions. In practice it means skiing on a constructed slope or bank: a dry slope, an indoor slope or an artificial embankment. If that takes place in the Netherlands, your travel insurance does not respond; what counts then is your liability insurance and any personal accident cover.

If you fall because of a defect in the slope — a loose brush mat, a broken lift — the operator may be liable as the owner of the structure (Article 6:174 of the Dutch Civil Code). If the same activity takes place in the mountains abroad, the usual winter sports exclusions come back into view.

Where things go wrong in practice

Two points that decide who bears the loss after a fall on the slope.

On a slope, the operator is often the first port of call

The owner of a structure is liable if it does not meet the standards that may be expected of it (Article 6:174 of the Dutch Civil Code). With a loose mat or a defective lift, that is the slope operator. If you collide with another skier, the ordinary standard under Article 6:162 of the Dutch Civil Codeapplies. Always have an accident recorded on the spot.

In the mountains the usual exclusions apply again

Travel and personal accident policies exclude off-piste mountain sports, air sports, diving below a stated depth and speed contests . If you ski the same slope on an unpatrolled embankment or off the marked piste, you fall into the first category. Report an injury within the period set by Article 7:941 of the Dutch Civil Code.

Do I need travel insurance for this?

Not if you ski on a slope in the Netherlands. Treatment costs then run through your health insurance and damage to others through your liability insurance. For a slope abroad, winter sports cover is needed.

The slope was badly maintained. What now?

Report the injury to the operator straight away and have it recorded in writing. As the owner of the structure, the operator may be liable under Article 6:174 of the Dutch Civil Code. Keep photographs and witness statements.

Does my winter sports cover apply on a dry slope?

That cover belongs to the travel insurance and only responds while you are travelling. It is not intended for use in your own country; check your personal accident and liability cover instead.

Is a race on the slope covered?

An informal speed classification quickly falls under the exclusion for competitions. For an organised competition the organiser usually arranges collective cover; ask about that in advance.
