In brief

Gaesterennen (German: Gästerennen) refers to the slalom race for guests that ski schools in Austria, Switzerland and South Tyrol organise at the end of the course week. Participants experience it as part of the ski lesson. Insurers see something else: a closed-off course, gates and timing.

Many travel, winter sports and personal accident policies exclude taking part in competitions and the training for them . Skiing on the piste is covered, but the Friday afternoon race is precisely what is not. Some insurers make an exception for recreational races outside any official structure. That distinction is set out literally in the conditions.

Where things go wrong in practice

Two points that determine whether your policy pays after a fall on the course.

Speed competitions are a standard exclusion

The exclusions in a travel or personal accident policy usually list four categories: mountain sports off the beaten track, air sports, deep diving and speed contests. A Gästerennen falls under that last category as soon as a clock is running. Entering through the ski school makes no difference.

The entry form is not insurance

Ski schools often have participants sign that they are taking part at their excess . Such a declaration limits the organiser's liability, but does not insure you. Report an injury to your insurer straight away as Article 7:941 of the Dutch Civil Code requires, and have the course management draw up an accident report.

Is a Gästerennen really a competition as far as my insurer is concerned?

Usually, yes. As soon as there are gates, a course has been closed off and times are being taken, the insurer applies the competition exclusion. The fact that the ski school presents it as the end of the lessons makes no difference to the conditions.

Does that apply to my children in ski lessons too?

Yes, the same provision applies to family members insured with you. With many insurers, children's races fall under the same exclusion. A number of companies make an exception for recreational races without official organisation; ask about that in advance.

How do I arrange cover?

Before you travel, declare that you are taking part in a race and ask for written confirmation or additional winter sports cover. Without that confirmation you bear the medical costs and the disability risk yourself.

What if I collide with someone during the race?

Then the question is whether you acted unlawfully within the meaning of Article 6:162 DCC. In a sporting situation, not every mistake is immediately regarded as unlawful. Report the incident to your liability insurer and admit nothing on the spot.
