In brief

Hairdressers, beauticians, foot care specialists, nail technicians and tattooists work with substances and equipment that act on the skin. The damage that results is classic and readily insurable: an allergic reaction to a colourant, a burn from leaving a product on too long or from equipment, an infection after a treatment. That is injury and falls under public and employers' liability insurance, provided the treatment you carried out also appears on the policy.

And that is exactly where the problem lies. The description on your policy determines the cover, and the range of services in this sector shifts faster than the policy. Anyone who, alongside cutting, starts offering laser or IPL treatments, or moves into permanent make-up, injectables or chemical peels, changes the risk fundamentally. Such treatments come with their own certification and inspection requirements and are not covered without being declared; misrepresenting the position when taking out the policy also runs into Article 7:928 of the Dutch Civil Code.

The second dividing line runs between damage and disappointment. A colour that does not give the desired shade, a cut that falls short or a tattoo the client does not like is neither injury nor property damage. The cost of redoing your own work falls outside every liability policy. What is insured is what you damage at the client's expense, not what you have to do again.

What does your premium depend on?

  • Treatments on the policy. Cutting and styling weigh differently from laser, injectables, peels or permanent make-up. The description drives the rate.
  • Annual turnover of the salon. Turnover is the usual basis of calculation for the liability section, including turnover from product sales.
  • Number of treatment chairs and staff. More treatment places and more staff mean more treatments per year and higher exposure.
  • Equipment present. The type, age and inspection status of laser, IPL and heating equipment determine both acceptance and premium.
  • Business contents and stock. The value of furniture, mirrors, wash units and products determines the sum insured on the business contents cover.
  • Working on location or at clients' homes. Treatments outside your own salon call for a separate mention and affect the cover for third-party property.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

The consultation form is your evidence

Before every treatment with colourants, acids or equipment, ask about allergies, medication, pregnancy and earlier reactions, and record the answer with a date and signature. If you carry out a patch test, note the result as well. If a reaction develops later, this form is the only thing with which you can show you acted carefully. A question asked verbally without a note counts for nothing in the assessment of a claim.

Equipment brings inspection and competence requirements

Laser, IPL, radiofrequency and heated equipment call for demonstrable maintenance, periodic inspection and a competent operator with the right training. Insurers accept on the basis of that regime. If you work with expired inspection documents or let a member of staff treat clients without the required training, the insurer can refuse cover; where safety rules are deliberately departed from, Article 7:952 of the Dutch Civil Code comes into play. Keep the log book and the certificates together.

Clients' belongings fall under care, custody and control

A coat with bleach marks, glasses falling off the stand, a bag that ends up in the basin: those are items in your had in your care. That damage is excluded as standard and only covered with a care, custody and control clause. The same applies to a client's car on your premises and to jewellery the client hands over during a treatment. Check whether your policy contains this extension and up to what limit.

If you sell products, you sell risk

If you pass on shampoo, creams or varnishes, Article 6:185 of the Dutch Civil Code applies to you as soon as that product causes damage. On resale of a branded product, liability in principle rests with the producer, but if you put your own name on the packaging or mix products yourself, you become the producer. Declare the turnover from sales and keep supplier details and batch numbers, because without traceable provenance the claim stays with you.

Am I liable for an allergic reaction to a colourant?

That depends on what you did beforehand. If you asked about allergies and earlier reactions, recorded that and carried out a patch test where needed, your position is strong. Without that record, carelessness is assumed and the injury claim is for your account. The insurer assesses your consultation form, not your recollection of the conversation.

Is a cut or colour that goes wrong insured?

No. A disappointing result is neither injury nor property damage, but disappointment with the quality of your work. The cost of putting it right, recolouring or refunding the treatment falls outside every liability policy. Only where skin damage, hair loss or a burn occurs does injury cover come into play.

Can I simply add laser or IPL treatments?

Not without informing your insurer. These treatments bring their own training, inspection and maintenance requirements and change your salon's risk profile. An undeclared activity is a ground for refusal when you claim. Report the extension in advance, keep the inspection documents for the equipment and make sure every operator is demonstrably qualified.

Who pays for a coat discoloured during a haircut?

Without care, custody and control cover, you do. Clients' clothing, bags, glasses and jewellery are property in your custody, and that category is excluded as standard on public and employers' liability insurance. With a care, custody and control clause this damage is covered, up to the agreed limit and usually with an excess per event.
