In brief
Finass is an independent intermediary. We do not place your insurance with one company because we have ties there, but because the conditions match what you do. For a self-employed professional in care that means a policy that also insures injury and health damage arising from your professional practice. A standard form covering only pure financial loss is written for advisory professions and leaves open precisely the loss you have to deal with.
On an application through Nationale-Nederlanden for the self-employed or through another company, we check the same points every time: which reserved procedures you carry out, in which settings you work, whether you also advise or train, which retroactive date you need, and whether assistance in disciplinary proceedings can be included. The outcome of that review determines which insurer the application goes to.
Also watch the contracts you sign with clients. Institutions and placement agencies include an indemnity as standard, and liability you carry solely on the basis of such a clause is excluded on virtually every policy. We read that clause through with you before the insurance starts. How this product works in general is set out on the hub page on the BAV.
This page deals with one situation. The full overview is on Compare professional indemnity insurance (BAV).
What we look at in your application
Four points that determine whether a quotation from this or another company suits you.
The description of your activities
A policy covers what is on the schedule and nothing beyond it. Nursing procedures, support work, wound care, maternity care and training are different capacities. If part of it is not stated, the insurer can rely on Articles 7:928 and 7:930 of the Dutch Civil Code. So we prefer to have the description drawn too widely rather than too narrowly.
Retroactive cover, run-off cover and the retroactive date
The cover works on a claims-made basis: the moment of notification determines which policy a claim falls under. If you worked earlier without insurance, prior acts cover is needed for that period. If you stop or take up employment, run-off cover is needed for claims that still come in afterwards. Both have to be arranged in advance.
Several clients under one policy
Most self-employed professionals in care work for several institutions at once. Your policy is in your own name and follows you from assignment to assignment, provided the activities match. If a client asks for a higher sum insured than you have, tell us before you sign the agreement.
What no company covers
Whichever insurer you choose, the following stay outside the cover: disciplinary measures and administrative fines; intent and wilful recklessness (Article 7:952 of the Dutch Civil Code); circumstances already known when the policy was taken out; liability accepted under contract above your liability in law; and redoing or repaying your own work.
What does your premium depend on?
- Profession and procedures: the basis of underwriting at every company
- Annual turnover: the common basis for the premium
- Settings in which you work: emergency care and intensive care differ from district nursing
- Sum insured and excess: per claim and per insurance year
- Retroactive period: for work from before the start date
- Additional sections: such as assistance in disciplinary proceedings, with a limit of its own
Insurers weigh these details differently. That is where your saving is.
What is covered
| Situation | AVB | BAV |
|---|---|---|
| You administer a medicine in the wrong dose and the client has to be admitted | No | Yes |
| A client slips out of the hoist sling during a transfer and breaks a hip | No | Yes |
| During a home visit you knock a television off the client's cabinet | Yes | No |
| The laptop you have on loan from the institution falls out of your bag in the street | No | No |
| An incorrect entry in the client record leads to a wrong care assessment that the institution has to repay | No | Yes |
| You are infected yourself through a needlestick injury while setting up an infusion | No | No |
For self-employed professionals in care, what matters most is that injury arising from your professional work is on the BAV and not on an advisory variant.
Frequently asked questions
This is what people ask us most.
Can I also go directly to Nationale-Nederlanden?
You can, but then you are comparing one offer with itself. We put several companies side by side on the points that count in care: injury to persons, the description of your procedures, retroactive and run-off cover. Once the policy is running, we arrange changes and guide you through a claim notification, so that you do not have to deal with the claims department yourself.
What if another insurer suits me better?
Then we recommend that one. Our role is to compare, and the choice follows from what you need cover for. For some professional groups in care the market is limited, for example for intensive nursing procedures. The willingness of insurers to accept the risk then determines which companies remain. We explain that in advance, with the differences in conditions alongside.
I work in care and also give training. Can that go on one policy?
Often yes, but it has to be stated expressly. Training and advice are a different capacity from providing care, with a different loss profile: there it is usually about a client's financial loss. State both activities and their relative size when you apply, and the cover will be matched to them.
How does reporting a claim work?
You report the claim or the incident to us or directly to the insurer, as soon as reasonably possible; Article 7:941 of the Dutch Civil Code requires this. Do not admit liability and do not promise any payment, because that can affect the cover. The insurer assesses liability, conducts the defence and pays out if the claim is justified.
