In brief

At home it comes down to four blocks. Home: the buildings insurance for the building and home contents insurance for everything loose inside it. Motor: the car insurance and related cover. Liability: the personal liability insurance for damage you cause to someone else. Legal help: the legal expenses insurance for disputes. Anyone combining those four in a insurance packageis left with one renewal date.

For business owners the structure is different. The public and employers' liability insurance covers injury and property damage to third parties, the professional indemnity insurance covers pure financial loss arising from advisory and design work, and the directors' and officers' liability insurance covers directors' personal assets. Alongside these are the business assets themselves: business contents and goods and the business interruption insurance for turnover that comes to a halt. Digital risks belong on a cyber insurance.

Most problems arise not within one policy but between policies. Liability insurance reimburses damage to someone else, never your own loss. Legal expenses insurance conducts a dispute, but does not itself pay compensation. Damage caused by a motor vehicle runs through the compulsory insurance under Article 2 of the Dutch Motor Insurance Liability Act (WAM) and not through a liability policy. When putting a portfolio together we pay particular attention to those transitions.

Four borderline cases where people assume something is covered while it belongs to another policy.

Buildings and contents: where does the building end

Everything permanently attached to the house falls under buildings. What you take with you when you move falls under contents. With solar panels, a kitchen in a rented home or a veranda you have installed yourself, discussion arises. As the possessor of a defective building you are also strictly liable under Article 6:174 of the Dutch Civil Code, even without fault on your part.

Liability never covers your own loss

Liability insurance only comes into play once a third party holds you liable, usually under Article 6:162 of the Dutch Civil Code. It does not reimburse your own damaged belongings. That requires home contents, buildings or business contents insurance. Damage between insured family members also falls outside cover as a result.

What every policy excludes

Recurring exclusions are those for intent and recklessness (Article 7:952 of the Dutch Civil Code), for war risks and nuclear reactions and for earthquake and flood. Also wear and tear, inherent defect and deferred maintenance fall outside cover virtually everywhere, because that is not a sudden, unforeseen event. Fines and penalty payments are insurable nowhere.

Private or business use

The dividing line between a personal and a commercial policy is use. If you work from home, use the car for the business or store trading stock in the garage, that falls outside personal cover. Report it in advance: under Article 7:928 of the Dutch Civil Code you must answer the questions on the application in full.

What does your premium depend on?

  • Type of insurance: the risk of the product determines the base premium
  • Sum insured: rebuild value, contents value or turnover
  • Type of cover chosen: limited or extended cover
  • Excess: a higher excess lowers the premium
  • Package discount: several policies with the same company
  • Claims history: previous claims count towards acceptance and premium

Frequently asked questions

This is what people ask us most.

Can I place everything with one insurer?

Often yes, and that provides a discount and one renewal date. It is not an end in itself: sometimes a company will not accept an unusual risk, such as a thatched roof or a business at home. Spreading the risk is then wiser. We assess case by case what works out best and explain the difference before you choose.

Am I insured twice somewhere?

That happens regularly, for example with legal expenses cover running both separately and within a package, or with travel cover already included in a credit card or a continuous policy. Insuring twice does not produce a double payout; indemnity insurance pays no more than the actual loss. A review of your policies removes those duplications.

Which insurance is compulsory?

For a motor vehicle, liability cover is compulsory under Article 2 of the Dutch Motor Insurance Liability Act (WAM). Basic health insurance is compulsory by law. An obligation can also follow from a contract: a mortgage lender requires buildings insurance, and a landlord or client may require liability cover. The remaining insurance is a matter of your own judgement.

What if my situation changes?

Report it. Building work, moving house, moving in together, a new car, taking on staff or a second activity within your business almost always affect one or more policies. An unreported change can lead to a lower payout when there is a claim. We adjust the policies and check whether the sums insured are still right.
