In brief

Property management turns on three things: the building itself, the liability that ownership brings with it, and the income from rent. An ordinary home policy does not cover that: insurers have separate conditions for let property, with their own requirements on use, maintenance and vacancy.

The liability of the possessor of a structure is governed by Article 6:174 of the Dutch Civil Code: if someone is injured through a defect in the building, you are liable as possessor, even where you are not at fault. If you manage property for others, liability for your own advisory and management work is added; that falls under separate liability cover for property and not under the buildings policy.

Professional indemnity for management and advisory errors runs through a separate policy. The buildings and liability covers do not provide for it.

Where things go wrong with managed property

Two points that decide whether a claim on let property stands up.

Maintenance is a condition of insurance, not a choice

Under Article 6:174 of the Dutch Civil Code you are liable as possessor for damage caused by a defective structure. Insurers exclude damage caused by deferred maintenance, wear and design faults and ask about your maintenance history when you claim. Record inspections of the roof, facade, electrical installation and heating system. That file is your most important evidence when a claim is made against you.

You must report vacancy and any change of use

If a building changes from a dwelling to rooms let separately, business activity moves in or it stands empty for longer, the risk changes. Insurers often limit cover during vacancy to fire and storm and then exclude burglary, vandalism and water damage. Likewise, illegal occupation or cannabis cultivation is excluded. Report changes: when taking out the policy, Article 7:928 of the Dutch Civil Code and a breach can reduce the payout (Article 7:930 of the Dutch Civil Code).

This is what people ask us most.

Can I insure a let property on an ordinary home policy?

No. Letting is a different risk from owner-occupation and must be declared as the use. If the policy states that you live there yourself while the property is let, the insurer may reduce or refuse the payout. Separate conditions apply to let and managed property, often with their own requirements on maintenance and vacancy.

Who insures what for a flat in a VvE (Dutch owners' association)?

The owners' association insures the building as a whole. That follows from the regulations attaching to the apartment right under Article 5:112 of the Dutch Civil Code. As owner you insure your own interest: contents or tenant's improvements, your liability and sometimes improvements to the flat. Check whether the VvE policy covers the rebuild value of the entire complex.

What happens if a property stands empty temporarily?

Report it to the insurer. Most policies limit cover during vacancy to fire, storm and explosion and exclude burglary, vandalism and water damage. Additional requirements sometimes apply, such as shutting off the water and draining the pipes. Without notification the insurer may rely on the changed situation when you claim.

Am I liable if a tenant falls on a slippery staircase?

You may be. Article 6:174 of the Dutch Civil Code places liability with the possessor of a structure that does not meet the standards that may be expected of it. Whether that is the case depends on the condition of the staircase and the maintenance. Liability cover meets the costs, provided the defect does not stem from deferred maintenance.
