In brief

The most common request is for proof of insurance. Clients, contracting authorities and main contractors often ask for it before the first working day, sometimes with a minimum sum insured and a particular description of the activities on it. We ask your insurer for such a statement. At the same time, check whether the requirements in the contract match what is on your policy: a required cover for advice calls for professional indemnity insurance and not for your liability insurance for self-employed professionals.

The second reason to get in touch is that your work changes. A new service, a first subcontractor, tools you buy in addition or a job just over the border: each of those belongs on the policy schedule. Report them through notifying a change. On liability policies the premium is also calculated on turnover or payroll and adjusted afterwards; a declaration of turnover that has been set too low leads to an additional charge at the adjustment.

The third reason is a claim. If a client reports a loss, forward the letter, the email or the claim form without responding on the substance. Do not admit liability, do not promise to put things right and do not pay anything in advance: your policy provides that the insurer handles the claim and conducts the defence. You record a claim through report a claim, because Article 7:941 of the Dutch Civil Code requires you to notify as soon as you can reasonably be aware of the loss.

A question about cover is not cover

A telephone call or an email from us is an answer to your question, not an undertaking by the insurer. Cover only arises with an accepted application or interim cover confirmed in writing. If you start a job in a new field on Monday, arrange the amendment the week before and not afterwards.

Have contract requirements checked in advance

Clients regularly include in their terms liability going further than the law: a warranty, a penalty clause or an indemnity for all loss. That part is insured on no policy. So have a contract reviewed before you sign, not after a claim has arrived.

Your own injury runs through a different policy

Liability insurance covers other people's losses, not your own. If you fall off a ladder, there is no employer holding you liable and no cover on your AVB. For that there are disability insurance and the personal accident insurance.

Stopping, pausing or switching

If you cancel professional indemnity insurance, cover stops for claims arriving afterwards about past work. So call before you cancel, so that run-off period can be arranged. The same applies when switching: only let the old policy end once the new one is confirmed in writing.

What does your premium depend on?

  • Description of your work: the insured capacity determines what is covered
  • Annual turnover: the basis for the premium and for the adjustment
  • Hiring in others: if someone works under your direction, that counts
  • Sum insured: clients sometimes set a minimum for this
  • Excess: per claim; a higher risk retained means a lower premium
  • Working area: work outside the Netherlands calls for separate acceptance

This is what people ask us most.

What should I have to hand when I contact you?

Your policy number, your Chamber of Commerce number and the description of the job concerned. For a claim, photographs, the order confirmation, your terms and conditions and the other party's details also help. For a change, state the start date you want. With those details we can put a question to the right insurer in one go.

My client requires a higher sum insured. Can that be done quickly?

An increase can usually be arranged in a short time, but it remains an application the insurer has to accept. So apply as soon as the requirement is known and not on the day you want to start. We check straight away whether the description of the work required matches the insured capacity on your policy.

Can I still report a claim if I am unsure whether it was my fault?

Yes, and that is the sensible course. Assessing liability is for the insurer, not for you. Also report a circumstance that is not yet a claim, such as a complaint or a mistake you have spotted. On a policy working from the moment of the claim, such a notification fixes the insurance year in which the matter is handled.

Do you also arrange private insurance alongside my business policies?

Yes. Many self-employed people have business and private cover running side by side, for instance a car used for both business and private purposes or tools kept at home.
